Recreational Facilities Agreement Form

White Springs Recreation Association is responsible for governance of the affairs of the White Springs Recreational Facilities including The Clubhouse, Fitness Center, Pool, Pavilion, Courts & Walking Trails.  The Recreational Facilities are for use by all residents of White Springs at Providence (Regency Community Association & Manors Community Association).  All residents of White Springs at Providence are required to sign this form for the use of the facilities.  

In consideration of the right to use the White Springs Recreation Facilities, the undersigned acknowledges and agrees that the White Springs Recreation Association, the Regency Community Association and the Manors Community Association, and each of their respective officers, the management company, and all their affiliates, agents, employees, successors, or assigns shall have no liability what-so-ever for any claims, losses, damages, liabilities, demands, costs, and expenses (including attorney’s fees and costs), arising out of any illness, sickness, personal injury (including death), property damage, or loss which may be sustained by the undersigned, their occupants and their guests because of or while using the White Springs Recreation Facilities, whether caused in whole or in part by the act or omission of the White Springs Recreation Association, its officers, the management company, and all their affiliates, agents, employees, successors, or assigns, or any cause what-so-ever.  

In this regard, the undersigned hereby assumes all risk of such occurrences and to hold the White Springs Recreation Association, Regency Community Association & Manors Community Association, its officers, the management company, and all their affiliates, agents, employees, successors, or assigns as harmless and to indemnify and defend the same against any and all claims, losses, demands, liabilities, damages, liens, costs, expenses, costs, expenses (including attorney’s fees and costs) arising directly or indirectly from such occurrences.  

I have read the RESOLUTION OF THE EXECUTIVE BOARD OF WHITE SPRINGS RECREATION ASSOCIATION, INC. ADOPTING RECREATIONAL FACILITY RULES AND REGULATIONS and agree to abide by them.  

I understand there is no trainer on duty at the fitness center, nor lifeguard at the pool, and I will use the facilities at my own risk.  

As a resident of White Springs at Providence (Regency Community Association & Manors Community Association), I accept responsibility to see that my occupants and my guests follow the Rules & Regulations of the Recreational Facilities and all that they include.  I accept full responsibility for any and all claims for any damages caused by my occupants and my guests.  I understand Regency Community Association or Manors Community Association may assess me (or the Owner of the Unit if I am a tenant) for payment of such claims.  I agree use of the fob is restricted to residents.  

I have read the above waiver of liability and understand and agree with its stipulations.  Signatory acknowledges that he/she is signing for occupants in the unit listed below.
