In consideration for the Weddington Chase Homeowners Association (WCHOA) allowing me the exclusive use of the Weddington Chase Clubhouse and equipment and furnishings, I, the undersigned, agree as follows:

1.  This agreement between the WCHOA and , a member of the Association “Member”, establishes the conditions and requirements for rental of the WCHOA clubhouse by the Member on ("Event Date"). 
2. Member agrees to the following Reservation Requirements.
   • The event needs to be scheduled through FirstService Residential, Inc.
   • All initial and signature blocks of this agreement must be completed and returned with the rental fee and security deposit checks within seven (7) days of the initial reservation request in order to keep your reserved rental date.  Send this information to: FirstService Residential https://eastsupport.fsresidential.com/
   • The event is for the member or their family.  Rental to non-residents is prohibited, including renting the clubhouse for a friend outside the neighborhood.
   • Member must be 21 years of age. Events for persons under the age of 21 must be chaperoned by family members over the age of 21.
   • Member agrees to limit the number of guests to 75, unless approved by the WCHOA.
   • Member needs to prearrange a walk through, set up time and clean up time with Nina Beglin prior to the date of the event; such allowances are completely dependent on Clubhouse activity.

   • Member agrees to complete the all aspects of the attached Weddington Chase Rental Agreement Clean-Up Checklist.

3. I am reserving the Clubhouse for the purpose of , which will be attended by not more than people. I understand rentals are for exclusive use of association members and their family members.

4. The party or other function will be held between the hours of and on the date noted above. And I request access to the Clubhouse beginning at and ending at . I understand that continued use of the Clubhouse after the hours for which it has been reserved will constitute a breach of this Agreement and will result of forfeiture of my deposit. If you need access to the clubhouse the day before for setup or the day after for clean up, you must request that with Nina Beglin at 609-276-3893 or  [email protected] to make sure the clubhouse is available and to have the doors unlocked.
5. I will send a non-refundable deposit (made to Weddington Chase HOA, and mail to: Attn: Weddington Chase HOA, 5970 Fairview Road, Suite 710, Charlotte, NC 28210) in the amount of 175.00 for the Clubhouse, and a refundable security deposit in the amount of $500.00, which are due and payable upon submission of this Application and Reservation Agreement. (Please include two (2) separate checks for the rental amount and the refundable deposit). I understand the entire deposit will be refunded to me if in the event of cancellation of my reservation one week (7 days) or more before the reservation date. I further understand and agree that the refundable security deposit may be used to pay for cleaning costs and any and all damages resulting to the Clubhouse, its contents, or any other portion of the property from any actions or any actions of persons present at, or attending, or in any other way related to my function. I understand that any charges made against my refundable security deposit will be explained. If the cost of repairs exceeds the amount of my refundable security deposit, I agree to pay the Association the full cost of all repairs within ten (10) days of receipt of a written explanation of the damages and a bill from the Association for such repairs. I agree that all deposits, fees and expenses incurred by the Association as a result of the use of the Clubhouse under this Agreement shall be considered as an assessment and constitute a lien against my property and shall be fully collectible as such as provided for in the Association’s Declaration and By-Laws.
6. I assume all responsibility, risks, liabilities and hazards incidental to the activities applied for and hereby release and forever discharge the Association, its officers, directors, employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability for personal injury or death and damage to or destruction of property arising from my use of the Clubhouse and its appurtenances.
7. I agree to indemnify and hold harmless the Association and John Wieland Homes and Neighborhoods, Inc., its officers, directors, employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability 4(including, but not limited to, attorney fees) for any injury, to either person or property, suffered by me, my family members, employees, agents, servants, guests, invitees or any member of the Association or any other person which arise from or are in any way related to the above activity, whether or not caused by the Association's negligence. 
8. I assume all responsibility for the actions and behavior of all persons present at, attending, or in any other way related to my function and agree to be personally responsible for causing all such persons to comply with the Association’s Declaration, By-Laws and Rules and Regulations. I acknowledge that violation thereof by any person present at, attending, or in any other way related to my function may, at the sole discretion of the Association’s Board of Directors, result in forfeiture of my refundable security deposit.
9. I understand that I am being granted exclusive use of the Clubhouse for the time period described above subject to the right herein reserved by the Association to enter the Clubhouse and terminate my use thereof should the conduct of any person using the facility endanger health, safety or well-being of any person or constitute a threat of any property. 
10. By reserving the Clubhouse, I also understand and agree to be bound by the rules and regulations governing the use of the pool. Specifically:
    • The pool cannot be reserved for exclusive use - there are no special pool privileges that come with renting the Clubhouse.
    • Four (4) guests per household are allowed at the pool unless written arrangements are made with the pool committee. 
11. I am an Association member in good standing, at least 21 years of age, and will be in attendance at my function. I hereby agree and represent that the Clubhouse will be used for lawful purposes only and that if any conduct at the function I am sponsoring violates federal, state or local laws or ordinances, my rights to use the Clubhouse under the Agreement shall be terminated and the Association shall have the right to take possession of the Clubhouse and instruct my guests to leave the property.
12. In the event of cancellation of my reservation one week (7 days) or more before the reservation date, all deposits will be refunded in full.  Cancellation after this time period will result in a charge in the amount of your non-refundable deposit.
13. Subject to those deductions provided for in this Agreement, the refundable deposit will be refunded in whole or in part by mail after the Association makes a post-inspection of the property.
14. I agree to clean the facilities by midnight on the day of my event. *If the Clubhouse is not cleaned by midnight of the day of the event, the refundable security portion of your deposit will not be returned, unless other specific arrangements have been made ahead of time. I have read and signed the Cleaning Checklist. 
15. I understand that my reservation of the Clubhouse on the aforementioned date will not be confirmed nor will this Agreement be binding until such time as the Association has executed this Agreement.

 Clean-Up Checklist

FLOORS

• Vacuum all rug areas
• Wet mop the entry tile floors and kitchen area

KITCHEN

• Remove or Discard all food
• Remove all garbage
• Remove all personal items from the refrigerator
• Wipe down refrigerator, sink, countertops and stove
• Ensure ALL appliances are turned off

SITTING AREAS

• Discard all food
• Wipe off tables and chairs
• Ensure all furniture is in its original position as you found it
• Remove all decorations
• Reminder Piano cannot be moved
• No nails or regular tape is to be used on the woodwork
• Tables and Chairs brought down from the loft need to be taken back up and secured properly

GENERAL

• Place all garbage in trash bags, remove and dispose of all trash, immediately after the function is over. Place all trash and recyclables in the outdoor trash containers on the right side of the Clubhouse. Note: if all trash is not removed your deposit will be forfeited.                                                                              
• Turn off all lights and ensure all doors are locked.
• Put thermostat back to original schedule if you moved it up or down
