THE PARKS OF CAROLINA FOREST COMMUNITY ASSOCIATION, INC.
CLUBHOUSE RENTAL AGREEMENT

 

In consideration The Parks of Carolina Forest Association, Inc., allowing the exclusive use of The Parks Amenities Center and equipment and furnishings therein (the "Clubhouse"). I, the undersigned am a member of The Parks of Carolina Forest HOA Inc. agree to the following:

EVENT DETAILS

1. I agree to rent the Clubhouse at The Parks of Carolina Forest under the Terms and Conditions set
out below on the following date:

3. The use of the clubhouse will be for the following type of event: and will have approximately people attending. (MAX 75)
4. I agree that the function will be complete by p.m. and I understand that continued use of the Clubhouse after the hours for which it has been reserved will constitute a breach of this Agreement and will result in additional charges, the removal of my rental privileges for future events, and forfeiture of deposit.  
5. I understand that my reservation of the Clubhouse on the aforementioned date will not be confirmed, nor will this Agreement be binding, until such time as the Association has executed this Agreement.  

RESERVATION FEES & DEPOSITS

6. I will pay a security deposit as indicated above for the requested hours via (check or money order made out to the Parks of Carolina Forest) to reserve the date of the clubhouse rental. The security deposit will cover any charges for cleaning cost and any and all damages resulting to the clubhouse, its contents, or any other portion of the Association property from my actions or any actions of persons present at, attending, or in any way related to my function. If there are any incidentals an explanation of charges will be provided from the management company.  
7. In addition to the security deposit, I will make a rental fee payment to the Association as a member or in accordance with this agreement for each six-hour block of time I have reserved. Reservations may be made for morning (9 a.m. to 3 p.m.), evening (4 p.m. to 10 p.m.) or all day (9 a.m. to 10 p.m.).  
8. I understand the security deposit and a completed reservation agreement will reserve the rental of the clubhouse. Please note that the clubhouse is not confirmed until the security deposit and reservation agreement is received at least three (3) weeks prior to the event delivered to the management office.  
9. I understand the rental payments must be received three (3) weeks prior to the event dated. A $50.00 cancellation fee will be charged, from the security deposit or rental fee, if the event is cancelled less than three (3) days in advance of the event date. The remaining rental and security deposit will be refunded.  
10. I further understand that I am responsible for any charges for cleaning and repairs that exceed the security deposit. An invoice will be sent explaining all charges and the invoice payment will be due and payable upon receipt. As a homeowner of The Parks of Carolina Forest, I agree that all fee and expenses incurred by the Association as a result of my renting the Clubhouse under this Agreement shall be considered an assessment and constitute a lien against my property and shall be fully collectible as provided for in the Association's Declaration and By-Laws. I further understand that any remaining balance from the security deposit will be mailed to me within 10 days of the event.  
11. I agree to return the Clubhouse keys to the Clubhouse Representative at final inspection/ check-out (end of rental period) or before 9 a.m. the following morning. I understand that if the key to the clubhouse is not returned there will be a $50.00 charge.  
12. The Clubhouse is a NO SMOKING facility. Smoking in the Clubhouse will result in the imposition of a $200.00 fine, taken from Renter's deposit.  
13. I agree that no person at the Function shall be charged any type of admission fee to attend the Function and that nothing will be sold at the Function.  

ADDITIONAL TERMS & CONDITIONS
14. I understand that I am being afforded the exclusive use of the Clubhouse only, the use of the pool and other surrounding amenities by persons attending my function is NOT included and such persons will not interfere with use of the pool, pool area, gym, playground, pier, firepit, picnic tables or other amenities by persons not attending my function. The use of bounce houses, tents, lawn chairs, etc., set up in the landscape common area outside of the clubhouse is not permitted. The concrete area directly outside of the clubhouse (not in the pool area) may be utilized with board approval. Vehicles, trailers, etc. are not permitted on the common area.  
15. I assume all responsibility, risks, liabilities, and hazards incidental to the activities applied for (including, but not limited to the serving of alcoholic beverages), and hereby release and forever discharge the Association, its officers, directors, employees, agents, and members, present, past, and future, from any and all claims, costs, causes of action, and liability for personal injury or death and damage to or destruction of property arising from my use of the Clubhouse and its appurtenances.  
16. If alcoholic beverages will be served at, or brought to the function, then I understand and agree that I am responsible for ensuring that any consumption or serving of alcohol at the function is done strictly in accordance with state and local laws. I further acknowledge and agree that no alcoholic beverages will be sold, manufactured or made at the function. Alcoholic beverages are prohibited in the club house when the guest count shall be more than 30 people, UNLESS a uniformed police officer is on duty the entire duration of the event. Alcoholic beverages are only to be consumed by persons 21 years of age or older.  
17. I agree to indemnify and hold harmless the Association, its officers, directors, employees, agents, and members, present, past, and future, from any and all charges, claims, costs, causes of action, damages and liabilities (including but not limited to attorney's fees) for any and all injuries, to either person or property, suffered by me, my family members, employees, agents, servants, guests, invitees, any member of the Association or any other person which arise from or are in any way related to the function and/or the rental or use of the Clubhouse.  
18. I assume all responsibility for the actions and behavior of all persons present at, attending, or in any other way related to my function and agree to be personally responsible for causing all such persons to comply with the Association's Declaration, By-Laws, and Rules and Regulations, including The Parks of Carolina Forest HOA Clubhouse Policy attached to this Agreement. I acknowledge that violation of any provision of these Documents by any person present at, attending, or in any other way related to my function may, at the sole discretion of the Association's Board of Directors, result in immediate termination of the function and forfeiture of my security deposit. I also agree additional charges could be assessed due to damages because any persons that might be related to my function.  
19. I understand that I am being granted the exclusive use of the Clubhouse for the time period described above subject to the right herein reserved by the Association to enter the Clubhouse and terminate my use thereof should the conduct of any person using the facility endanger the health, safety, or well-being of any person or constitute a threat to any property.  
20. I am a member of the Association, at least twenty-one (21) years of age, have no unpaid fees due to the Association, no outstanding liens or covenant violations exist on members property, and will be in attendance at the Function at all times during the Function. The member reserving the clubhouse must remain on the premises following the conclusion of the event until all attendees have departed. I hereby agree and represent that the Clubhouse Facilities will be used for lawful purposes only and that if any conduct at the Function I am sponsoring violates federal, state or local laws or ordinances, my rights to use the Clubhouse Facilities under this Agreement shall terminate and the Association shall have the right to take possession of the Clubhouse Facilities and instruct my guests to leave the property.  
21. I understand that all events may be monitored on camera.  
22. I understand that Commercial use of the clubhouse is not allowed.  
23. I agree to maintain a minimum 5:1 child to adult ratio of attendees.  
24. I agree to not allow guests to wear wet clothing inside the clubhouse.  
25. I agree to have guest’s park in the parking lot used for the pool.  
26. I understand that music or other noise shall not be heard outside the clubhouse and agree to keep the clubhouse doors closed at all times during the event. Entertainment is limited to inside the clubhouse.  
27. I agree to not move the clubhouse furniture inside or outside of the clubhouse.  
28. I understand that animals of any kind, except certified service animals, are not permitted in the clubhouse.  
29. The Association reserves the right to change the facility fee and deposit fee at any time. The Association also reserves the right to grant or deny rental of the clubhouse to anyone for any reason at the Association’s sole discretion.  
30. The Association reserves the right to allow the use of the facilities for events that are offered to all members of the association and may waive or reduce the facility fee and/or deposit for these events. These events will take precedence over private events.  
31. Catering must be in compliance with South Carolina Food & Beverage Law. Self-catered events by individual homeowners are subject to guidelines with regards to hygiene policy and food preparation. Please refer to USDA guidelines on Handling Food Safely.  

SETUP & CLEANING
32. I agree that all furniture, materials and supplies for my Function will be confined to inside the Clubhouse. The only exception is the area between the front of the Clubhouse (side with the address #s listed on it) and the adjacent bathroom, which Renters may use for setup of party materials, tables, decor, etc., but they may not take furniture from inside the Clubhouse into this area.  
33. I agree to be bound by the Clubhouse Policy attached hereto, and to clean the facilities before the designated time of post walk thru. I UNDERSTAND THAT CLEANING SUPPLIES WILL NOT BE PROVIDED BY THE ASSOCIATION.  
34. I understand that the charges listed on The Parks of Carolina Forest Clubhouse Cleaning Chart are those which I will be charged if the clubhouse is not returned in its original condition.  

CLEANING CHECKLIST
The following guidelines are to be reviewed by the Renter and a representative from the Amenity Center Oversight Group together upon completion of the event:
 All decorations removed from walls, ceiling and windows.
 Remove all leftover food and drinks from the premises.
 All tables and surfaces wiped off. Walls wiped down, if needed.
 Floor swept (and mopped if necessary) and rugs vacuumed thoroughly.
 Dispose of all trash items, including but not limited to food, drink and decorations supplied by the Homeowner, by bagging and removing from the premises.
 Place all furniture in original locations. All clubhouse decorations put back in original positions.
 All clubhouse furniture in good shape and free of crumbs.
 Using cleaning materials and tools provided by the Renter, ensure that all surfaces are left in no less than the same condition found at check-in.
 Remove all items brought onto premises, including rental items which may have been delivered. Items left at the Clubhouse after final walk-through will be disposed of.
 Re-set thermostats before leaving the building at 80° for Air Conditioning and 60° for Heating.
 Close and double check doors to be sure they are locked.
 Turn off all lights.
 The following items were found to be damaged or in disrepair as a result of the rental usage:
