SECTION A - PROXY VOTE: I, the undersigned voting member of The Gates Homeowners Association, Inc., do hereby appoint the Secretary of the Board of Directors or . In the event the secretary of the Association is not available, the proxy shall be held by “majority” of the Board of Directors at the meeting, to be held on Tuesday, May 19, 2026, at 7:00 p.m. and at any adjournment of such meeting with all powers which the undersigned would possess if personally present. SECTION C - APPROVAL OF RESOLUTION: Please fill out this section, whether you plan to attend or not.
RESOLVED, that any excess of Association Income over Association expenses as defined in IRS Reg. 70-604 for the year ending December 31, 2026, shall be applied against the subsequent tax year member assessments as provided by IRS Revenue Ruling 70-604. (The Board recommends voting for this resolution.) Please vote:

The Following paragraph shall replace Article VII, Section 1 (a) of the By-Laws:
a) adopt and publish rules and regulations governing the use of the Common Area and facilities and the personal conduct of the Members and their guests thereon, and to establish fines for the violations of such rules and regulations as well as fines for any violation of the Covenants and these By-Laws, which fines shall become a lien against the Member’s property and be enforceable in the same manner as liens for past due assessments.
