SECURITY DEPOSIT TERMS, REFUNDS, RESCHEDULING, RULES AND REGULATIONS FOR THE FARMERS REST AMENITY CENTER 
 

Rental Fee and Security Deposit

  • ALL private events must be scheduled through First Services Residential – [email protected].
  • A rental agreement, a $200 security deposit and a $200 rental fee must be received no later than 7 business days prior to the event to hold your reservation. Reservations will automatically be cancelled without receipt of the signed agreement and fees at 201 Sigma Drive within that time.
  • The deposit is refundable provided that all rules, regulations and requirements are followed.
  • If any violation of the rules and regulations occurs, The Farm at Wescott Homeowners Association, Inc. (hereafter “HOA”) has the right to retain a portion or all of your security deposit.
  • Events may not be scheduled earlier than 8:00 am nor continue past 10:00 pm.
  • The entire security deposit is automatically forfeited if you enter the Amenity Center before your actual rental date/time or you fail to vacate at your end date/time.
  • The entire security deposit is automatically forfeited if the police are called for any reason.
  • The entire security deposit is automatically forfeited if there is excessive loud noise which causes the police or a staff member to respond.
  • The renting property owner must contact an HOA Board representative (843-860-1237) the morning of the event to report any damage found prior to their event. The facility will be inspected by noon the following business day after the event.  Any damage noted, that was not reported prior to the event, will be deducted from the deposit.  Damage in excess of the deposit will be charged to the hosting property owner.
  • The Amenity Center must be returned to the condition it was in before the start of the event or any portion of the security deposit may be withheld.
  • All repairs, cleaning, and/or other adjustments are the financial responsibility of the Amenity Center renter and hosting property owner and any expenses incurred as a result of these items will be deducted from the security deposit. Any expenses over and above the security deposit amount are required to be paid to the HOA within one (1) week of the contract rental date. If those expenses are not paid within one week, then the HOA may, without limiting its other rights and remedies, take such steps as reasonably necessary to collect the unpaid amount. The hosting property owner must pay all costs incurred by the HOA in enforcing its rights to payment hereunder, including without limitation all costs of collection, including reasonable attorney’s fees and expenses incurred, whether before or after a suit for collection is brought, or a judgment obtained.

Refunds and Rescheduling Policy

  • No refunds or rescheduling will be granted unless notice is given 10 days prior to the contracted rental date.
  • No refunds or rescheduling will be granted for rental dates during May, June, or December
 
RULES & REGULATIONS OF RENTAL
  1. The Farmer’s Rest Amenity Center is available for rental by The Farm property owners in good standing and their resident renters only. The hosting property owner must be in attendance during the entire scheduled event. Non-residents of the Farm are not permitted to rent the Amenity Center. Renters of homes in The Farm may book the facility, provided their property owners sign this rental agreement where indicated and submit the usage fee and deposits directly. The hosting property owner assumes full responsibility for the event including the conduct of their tenant and all guests, and any damage that may occur.
  2. No one under 21 years of age may rent the Amenity Center.
  3. This rental agreement provides exclusive access to the Amenity Center Main Room and shared access to the restrooms only. The loft, gym, playground, pool, and deck area may not be reserved and are not part of this rental agreement. Pool and playground parties in conjunction with rental of the Amenity Center main room are not permitted. Event participants may not enter the pool area through the restroom or rear double doors.  Pool access may be made after the event only via the gate and guests must be registered with the pool attendant in accordance with the registered pool rules (posted on the bulletin board inside the gate entry).
  4. The HOA and Community Manager reserve the right to refuse use of the facility by any group or organization whose size is likely to strain the facilities or constitute a hazard in the event of fire or other emergency. The Maximum Capacity for any event is 65 people per the North Charleston Fire Marshall.
  5. Inflatable enclosures (jump castles, for example) are not permitted.
  6. Furniture arrangement and the facility must be left in the condition in which it was found. Those renting the facility must provide their own tables for their events (tables not provided). Pool-side tables and/or chairs may not be brought into the Amenity Center for private parties.  Chairs are available upon request at the time of the booking only.
  7. BBQ grills and propane heaters may not be used in or around the Amenity Center Complex. They may set up at the far right of the Handicap Spaces in the parking spaces past the tree. The property owner assumes full responsibility for supervising grills and/or heaters during the event, and any damage that may occur.
  8. The hosting property owner agrees to and understands that this facility may not be used to hold any political events, including: campaigns, demonstrations, rallies, or fundraisers.
  9. The Amenity Center has cameras in place throughout the facility including the pool area. Any inappropriate conduct that is reported will be viewed and the property owner will be held accountable.
  10. In accordance with SC DHEC laws and for safety of owners and their guests, ALL exterior doors and gates must be kept closed. The front door and restroom doors will have the mag locks disengaged during authorized rental events.  Doors may not be propped open at any time.
  11. Alarm will be set at precisely 10:00 pm by remote automation. Persons occupying any part of the facility after the alarm is set are trespassing and may be prosecuted, as well as the entire security deposit being automatically forfeited.
  12. Persons occupying the facility after hours, who trigger an alarm event, or whose failure to properly secure the facility allows triggering of an alarm will be charged a reasonable fee for time, travel and costs at a rate to be determined, and deducted from the security deposit.
  13. SMOKING IS NOT PERMITTED INSIDE FARMER’S REST FACILITY AT ANY TIME NOR IN THE PERIMETER OF THE POOL NOR PLAYGROUND FENCING – includes E-CIGS. Smokers outside the building are requested to dispose of their cigarette butts properly.   The smoking area is located to the right of the Amenity Center by the bike racks in front of the gym window only.
  14. No fireworks of any kind are permitted at or near the Amenity Center nor anywhere within the Farm at Wescott at any time.
  15. Pets are not permitted within the Amenity Center or grounds at any time.
  16. No “FOR PROFIT” events or lessons are allowed.
  17. Use of glitter is prohibited due to the difficulty in removing it from the grooved flooring.
  18. Balloons must be secured to ensure they do not rise to get entangled in the fan motors.
  19. Glass containers/objects are forbidden anywhere within the Amenity Center building, grounds or pool area.
  20. Use the facilities in a responsible manner and maintain them in good order.
  21. Do not damage the walls, woodwork, cabinetry, fireplace, or doorways to hang items. Command™ products (or similar non-damaging adhesive products) should be used to hang decorations and be removed at the conclusion of the event.
  22. Wedding parties are not permitted to throw rice. We recommend that birdseed or bubbles are used as an alternative.
  23. No parking on the grass.
  24. All outdoor activity must end by 10:00 PM.
  25. Music and noise levels must be kept at a level that will not disturb the neighborhood.
  26. All doors and windows must be kept closed to contain noise.
  27. If police are called for any reason, the event may be ended early and all guests required to leave at the HOA or manager’s discretion. The deposit will be forfeited.
  28. Do not take decorative items, cleaning supplies, tables, chairs, or any other property belonging to HOA outside of the Amenity Center.
  29. All personal and/or rental items must be removed from the Amenity Center by the expiration of your rental time on your rental day. Any items left in the Amenity Center will be placed outside by the trash containers, and items not taken away at the end of rental day will be discarded at the next trash pickup. HOA will not held liable.

GENERAL RULES AND REGULATIONS FOR THE AMENITY CENTER

In addition to the above rules and regulations, the following rules apply to all those who are present at the Amenity Center.

Persons must be 16 or older, unless accompanied by an adult, to have access in the Amenity Center Complex.

Any group with 10 or more individuals will have to reserve the Amenity Center to hold any type of function.  Scheduled events will take precedence over these unscheduled smaller gatherings.

HOA Community-wide events will be held from time to time at the facility and have priority over private events.  Private events may be scheduled by property owners on a 1st come/1st served space available basis. The hosting owner must be in attendance at any scheduled event at all times. 

Standard safety age restrictions for gym use are posted in the gym.

Neither First Services Residential management company nor the HOA assumes any liability for personal injury to or for the loss of personal property of property owners or their guests. 

When a private event is being held in the main room, gym users must use rear entry door to gym.

 

                                      ALCOHOL WAIVER AND INDEMNITY AGREEMENT

I understand that by executing this document, I am undertaking to rent the Amenity Center for a private party.. I  understand that should I elect to provide alcoholic beverages at my private party, consume alcohol on the property, or tolerate the consumption of alcoholic beverages at my party by those who may bring their own beverages, I acknowledge that I am solely responsible and liable for any and all injuries and damages suffered by myself or anyone else that may be caused as a result of said consumption, including, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium, and I further agree to defend, hold harmless and indemnify the HOA, and its officers and directors, employees, agents, and volunteers even if they are present as a guest at my party, from any and all claims, demands, injuries, damages, costs, loss of services, loss of consortium, expenses, actions or causes of action, of whatever kind or nature, associated with the consumption of alcoholic beverages at this event.

I, , have read the policy regarding Alcohol Waiver and Indemnity and agree to rent the Amenity Center under the above written conditions and responsibilities. 

 

RENTAL AGREEMENT TERMS AND WAIVER

Being of lawful age and capacity, the undersigned, on behalf of him/herself individually, and/or as parent and legal guardian of any children, and any and all, heirs, executors, administrators, assigns, and any successors in interest, does hereby forever release, acquit, discharge and hold harmless HOA and all officers, directors, board members, attorneys, and employees and volunteers individually, and in their official capacities, and all authorized representative(s), from any and all liability of any kind whatsoever for any actions, causes of action, claims, injuries, demands, damages, costs, loss of services, expenses, compensation, and all incidental and consequential damages, and any and all known and unknown injuries or damages of every kind and manner, on account of, because of, or arising out of, resulting from, or suspected or believed to have resulted from, the event activities described herein or any activities associated with this event or while on HOA premises, including without limitations, injuries or damages caused by the negligent acts or omissions of HOA or others.

I ensure that my guest(s) will be instructed on said rules prior to using the Amenity Center and will abide by them.

I understand that disregard for said rules and regulations by myself and guest(s) is just cause for the revoking of my use of the Amenity Center, and that I will not be entitled to refunds of monies paid.

I hereby accept full responsibility for my safety and that of my guest(s). HOA reserves the right to refuse or revoke the use of the Amenity Center at its sole discretion. 

I have received, read, and understand and agree to abide by the Security Deposit Terms, Refunds, Rescheduling, Rules, and Regulations for the Farmers Rest Amenity Center Rental as well as the General Rules and Regulations.

CLEANING RESPONSIBILITIES

The following list of items must be completed by the renter. Proper completion of the items on this checklist will help to ensure the refund of your deposit, but does not alter the terms of your contract. After the event those renting the facility must clean and remove all trash as outlined below– Cleaning supplies can be found in the cleaning storage closet on the first floor (broom, mop and mop bucket). 

  1. Remove all decorations and Command™ tape from the Amenity Center and other areas, including porches, stairways, walkways, parking areas, etc.
  2. All garbage generated by the event must be bagged and any overflow of the large cans on the side of the Pump House must be removed from the premises. Small cans on the property are not available for Events use.
  3. Clean all furniture as necessary.
  4. Furniture arrangement and the facility must be left in the condition in which it was found. Those renting the facility must provide their own tables for their events (tables not provided). Pool-side tables and/or chairs may not be brought into the Amenity Center for private parties.  Chairs are available upon request at the time of the booking only (please see below). Please stack and return the chairs in the same manner as they were found.
  5. Clean the following in the main room: Sweep and mop any spills from the floor
  6. Clean the following used items in the bathroom facilities: Sweep, mop any spills and clean any bodily fluids from the floor
  7. Turn off all lights, ceiling fans.
  8. Ensure all doors are secured in the Amenity Center before leaving.
