I understand and agree to all the following conditions and rules in reserving and utilizing the Providence Downs South Homeowners
Association Inc. Clubhouse ("Clubhouse"):
1. I am a homeowner in good standing with the Providence Downs South Homeowners Association Inc., i.e. all annual and special assessments are current and there are no outstanding liens or covenant violations related my property. Initial  
2. I have had the opportunity to inspect the Clubhouse prior to using it for my event and agree that it is in good and clean condition, and I have had the opportunity to notify the Clubhouse Committee in writing of any defects, concerns or needed repairs which were in existence prior to my use. I agree to accept any and all, responsibility for cleaning and any costs for any repair and or damage done to the furnishings or property on the Clubhouse premises in relation to the usage of the Clubhouse. This includes prohibiting the use of thumbtacks, nails, staples, glue, masking tape, etc. to attach anything to the walls, doors, furniture, trim, etc. Decoration of the Clubhouse should only utilize painter's tape and/or poster putty (fun-tak) to prevent any damage to walls and furnishings. Furnishings are not to be taken outside. If damage occurs through this type of use, repairs will be made and the cost deducted from the deposit and any amount over the deposit will be charged to the resident homeowner. Initial  
3. I agree to pay according to the following deposit and facility fee schedule. Initial  

Reservation Fee for a maximum of 8 hours (including setup and clean up)
$250 - 25 People or Less
$500 26 - 50 People
$750 51 - 100 People
Nonrefundable Post-rental Professional Cleaning Fee
(see #4 below and the Cleanup checklist attached)

Nonrefundable Post-rental Damage Fee
(see #5 below)

4. I agree to remove all trash from the premises, remove all items from the refrigerator, and wipe up any spills on the floors or furniture prior to vacating the premises. I agree to return the premises to pre-usage condition including ensuring furniture is in its original place, resetting the temperature controls, turning off the lights, and securing the premises. (Refer to Homeowner's Clean-Up Checklist) Initial  
5. The damage fee will be charged to the resident owner’s ledger if damages are present at inspection or conditions of this agreement have not been met. If damage is in excess of $500 the resident homeowner’s ledger will be charged for the costs of repairs, and such sums shall constitute a special individual assessment against the resident homeowner and his or her lot if unpaid. 6. Rental to non-community groups or for commercial or retail use is not allowed. Initial  
7. No sub-leasing or third party Rentals. Resident homeowners of Providence Downs South may only rent the Clubhouse. A resident homeowner must be present at all times during the rental period. Initial  
NOTE: Rental of the Clubhouse by a resident owner for use by someone other than a resident owner is strictly prohibited. Violations of this rule are grounds for permanent revocation of the resident owner's right to use the Clubhouse. Initial  
8. Rental of the Clubhouse does NOT include use of pool or access to pool area. Initial  
9. The resident homeowner responsible for the scheduling of the rental of the Clubhouse must be present at all times while the scheduled event is in progress. All Rentals (including the setup and cleaning) are limited to the hours of 8:00 AM to 10:00 PM Sun to Thurs and 8:00 AM to 12:00 AM Fri & Sat, with the maximum attendance of 100 people (downstairs) and 20 children (children’s room 2nd floor). All music must be contained within the Clubhouse. The parking lot may not be used as a part of the event other than for guest parking. Initial  
10. All signage posted by the Association or its management company in or around the Clubhouse shall be strictly observed. The Clubhouse (including the parking lot) is a smoke-free facility. Animals are prohibited at all times in the Clubhouse and surrounding pool area with the exception of guide/service animals. If smoking occurs, an additional clean-up fee of $500 will be assessed. 11. If you choose to allow the consumption of alcohol, you do so completely at your own risk, and you agree to indemnify and hold theAssociation, its officers, directors, employees, members, agents, and employees harmless from any and all liabilities which might arise orbe asserted. Only unfortified wine and beer may be served. If alcoholic beverages are served, the homeowner must obtain a limited special event permit or other such permits as required by state or local law and provide a copy to the management company. The sale of alcoholic beverages within the Clubhouse facility or charging admission or any fee of any kind at any event at which alcohol is served is strictly prohibited. Initial  
12. The Board of Directors reserves the right to change the facility fee and deposit fee. The Board of Directors also reserves the right to grant or deny rental of the Clubhouse. Community social functions shall take precedence over private rentals. Initial  
13. Violation of any of the Clubhouse Rules will be grounds for disciplinary action through the Board of Directors in accordance with the Association’s governing documents as well as potential revocation of Clubhouse privileges. Fees, costs, and fines assessed in accordance with this agreement constitute special individual assessments against the homeowner and his/her lot if unpaid. Initial  
14. The Homeowner agrees to indemnify and hold harmless the Association, its officers, directors, agents, members, and employees from and against any and all claims, liabilities, losses, damages, actions, costs, expenses, and demands of any party made or threatened against them arising out of or in connection with any event held in the Clubhouse by a homeowner pursuant to the reservation agreement or otherwise. I understand that the Board of Directors reserves the right to enter the Clubhouse and terminate my use thereof should I violate any term hereof or should the conduct of any person using the facility endanger the health, safety, or well-being of any person or constitute a threat to any property. I further agree to all of the above conditions in reserving and utilizing the Providence Downs South Clubhouse as well as the attached Clubhouse Rules. Initial  

Please Check the Community Clubhouse Calendar for available dates. Include a 2nd choice date as a backup. One event per day is allowed. First come basis. Hours are limited to 8:00 AM to 10:00 pm Sun to Thurs and 8:00 AM to 12:00 AM Fri & Sat.
