OYSTER POINT 

AMENITY RESERVATION FORM

 

CONDITIONS:
  1. Any Oyster Point HOA (OPHOA) homeowner must be current their assessments to rent any part of the amenities.
  2. Any assessment as to damages and/or violations of these policies is in the sole discretion of the Oyster Point HOA. The Oyster Point HOA reserves the absolute right to charge the responsible owner account in the event of any damages incurred to the Facility and/or for any violation of the Event Policies, Terms or Contract.
  3. Lessee/Host agrees to the following clean-up responsibilities before leaving the rental facility area. In the event these items are not followed, such failure will result in a charge to the responsible homeowner account:
    a. Ensure the facility is swept, kitchen is cleaned and all trash is properly bagged, removed from the facility and disposed of in the dumpster outside the premises.
    b. Furniture arrangement and the facility must be left in the condition in which it was found.
    c. The refrigerator is available for use during Brigade Room rental, however, all food items for the rented event must be removed and/or bagged with garbage and properly disposed of following the event.
  4.  All functions and cleanup must be complete within the rental period, no later than 11:00 p.m. the day of the event. The rental period should include sufficient time for setup and cleanup. Persons occupying the facility after hours will result in a charge to the responsible owner account. 
  5. All furniture is to be placed back as it was before the Event. Furniture in The Brigade Room cannot be moved outside. Failure to properly clean the rental space area or to replace the furniture as it was prior to the event will result in a charge to the responsible owner account. Any damage to the furniture will be at the Lessee’s expense . A furniture layout and pre-event and post-event check list will be provided the week prior to the scheduled event. Lessee is responsible for contacting the OPHOA to schedule the pre-event walk through.
  6.  Accessibility will be given for the timeframe reserved on the day of the Event as long as all monies have been paid. The doors will automatically unlock during the rental period.
  7.  The property owner reserving the facilities is responsible for the conduct of all guests associated with the event/activity.
  8.  Events organized chiefly for minors MUST be supervised by the owner and a sufficient number of responsible adults at all times and in all areas.
  9.  Neither D. R. Horton, Inc., FirstService Residential, nor the OPHOA assumes any liability for personal injury to or for the loss of personal property of homeowners or their guests using the Oyster Point facilities.
  10. The OPHOA and community manager reserve the right to refuse use of the facilities by any group or organization whose size is likely to strain the facilities or constitute a hazard in the event of fire or other emergency. Maximum capacity of The Brigade Room is 135 people as determined by the Fire Marshall.
  11. SMOKING IS NOT PERMITTED. Smoking is only permitted at the exterior footprint of the facility (parking lot, front and side walkways). No smoking inside the building, in the Open Air Pavilion area or on artificial turf green space. Smokers outside the building are requested to dispose of their cigarette butts properly.
  12. By order of the Fire Marshall, no grilling, grease cooking or deep frying will be allowed in the Brigade Hall or in or near any pine straw or mulch areas.
  13. Host agrees to respect the "quiet enjoyment" of the residents of the community.
  14. No minor o non-owner may reserve the amenities. A homeowner within the Oyster Point HOA may make a reservation for use by their renter. Rental leases may include a provision allowing the renter to reserve the amenities or the homeowner may provide separate letter saying as such. Any lease provision or letter allowing reservations to be made by the renter must be on file with FirstService Residential and must include the duration and signature of the homeowner.
  15. No pets are permitted within the Fitness Facility, The Brigade Room, Open Air Pavilion, or Pool Area at any time.
    No fireworks of any kind are permitted within Oyster Point at any time, without prior approval of the Board.
  16. Alcoholic beverages may be in the Brigade Hall but the liability is the responsibility of the homeowner. If there will be alcohol for the event, homeowners are required to obtain a rider added to their homeowner’s insurance policy for the date of the event. You may contact your insurance company for additional information regarding this item. The special event rider must include the following:
    a. Attendee Limitation with correct number of guests indicated expected to attend.
    b. Ensure there is liquor liability coverage with a minimum of $1,000,000 coverage.
    c. The homeowner/Lessee will hold Oyster Point Homeowners Association, its’ officers, employees and agents harmless from and against any and all claims, fees, penalties including reasonable attorney’s fees, arising out of use of clubhouse facilities; and will defend and indemnify Oyster Point HOA against such whether actual or alleged.
    d. Must include Oyster Point Homeowners Association, Inc. as an Additional Insured on the policy.
  17. Jump castles, water slides or inflatable devices that require the use of water are prohibited on HOA property.
  18. No fastening, gluing, taping on to wall. 3M command strip products are permitted.
  19. Fireplace: Open Air Pavilion parties with paid and confirmed reservation will have exclusive access to the fireplace during their rental times. Renters using the fireplace understand and agree to the following rules:
    a. This is a gas fireplace and all use must be supervised by an adult. The key to the fireplace must be requested from the HOA.
    b. Any mess from the use of the fireplace must be properly cleaned immediately after the private event. Wood fires are strictly prohibited.
    c. Any Lessee the uses the fireplace assumes all liability and is responsible for any damages.

 

ELIGIBILITY STANDARDS FOR RESIDENTS OF OYSTER POINT HOA:
An Oyster Point owner who is current with their Assessments is eligible to enter into a Contract for the following: the resident , immediate family member (husband/wife/children), place of employment (verification required), or school/ club/nonprofit organization (membership verification required) . The homeowner must be present at all times during the setup, event and clean up.


PROCEDURES AND RESPONSIBILITIES OF LESSEE:
1. The Lessee will be responsible to the HOA, including but not limited to the contract amount for any and all damages identified following the event rental.
2. If this Contract is falsified in any form, the Lessor will have the option to cancel the scheduled Event and Lessee will be liable for any and all appropriate fees as described in the contract.
3. Oyster Point has a non-negotiable contract for renting The Brigade Hall, Open Air Pavilion and green space. The signing of the rental contract for use of these facilities is legal and binding upon all parties.


RENTAL DETAILS
The Oyster Point Event Policies/Procedures, Terms, and Conditions are considered part of this Contract. No part of the rental contract or terms and conditions may be altered without a written agreement signed by both parties, nor may it be transferred or sublet by the Lessee. Your Event Date will be reserved upon receipt of this signed contract and receipt of event fee. Full payment must be received within 5 business days of the confirmation of your rental request.

Methods of Payment:
1. Mail check or money order, payable to Oyster Point HOA, to:

***Please ensure you write your property address and “BH Rental” with the date of your event in the memo on the check payment.
2. Online via the resident portal https://oysterpointhoa.connectresident.com/.
     a. Click 'Make A Payment' to access ClickPay.
     b. As the charge will not yet appear on your account, select the 'Edit' button next to the balance, then select 'Alternative Amount' to manually enter the rental fee amount.

RENTAL REQUIREMENTS:
The following information represents the guidelines for obtaining a rental of the various amenities within Oyster Point. For clarity, the Oyster Point HOA will be referred to as the "Lessor" and the homeowner or other party renting the Clubhouse facility will be referred to as the "Lessee.” The date of the scheduled Event shall be referred to as "Event Date."
1. The contract must be completed indicating the intended use of the facility and approved by the Board of Directors.
2. Reservations must be confirmed a minimum of 7 days prior to event. Reservations can only be made within a maximum 90 days.
3. Rental fees are due at time of the signing of the contract (please see rental schedule).
4. Payment of rental fee can made with check or money order, made payable to "Oyster Point HOA." A check fee of $35 will be assessed for returned checks. Payment can also be submitted through the resident portal. See instructions on previous page.
5. No function will be considered "booked " on the calendar until receipt of signed reservation form and rental applicable rental fees by the Lessor .

 

RENTAL FEE SCHEDULE per day:
The following fees are subject to change. Fees are in place to offset wear and tear, pay for the utilities used, and pay for routine maintenance and upkeep fees. Please check the box next to the amenity you want to reserve as well as the rental time you need.

I have read and agree to abide by the Oyster Point HOA Rules and Regulations with regard to the use of the Amenity/Facility/Clubhouse. I understand that I am responsible for cleaning the premises utilized at the end of my event and that if the premises are not left in a clean manner, or if damages occur my account will be charged a cleaning fee or for necessary repairs. I understand that I am fully and solely liable for any loss or damage caused by such use. I understand that I am fully and solely liable for any loss or damage caused by such use. I assume all responsibility and will indemnify, defend and hold Oyster Point HOA, its Trustees and the Declarant and their employees, agents and contractors, harmless from any and all losses, costs and liabilities related to my use of the clubhouse, including but not limited to reasonable attorney fees.
