MOSS CREEK AMENITY RESERVATION AGREEMENT

The Clubhouse will not be rented to any owner who has an outstanding account balance.

POLICY ON USE OF AMENITIES

  1. The Pavilion can be reserved only by Owners for their use and that of their invited guests. To reserve the Clubhouse, the Owner must be current in his/her regime fees and the Owner MUST attend the event. The Clubhouse WILL NOT be rented to anyone under the age of twenty-one and is not available for rental on any major holiday.
  2. The Clubhouse cannot be reserved for marketing events, sales events, or games of chance at which money will be exchanged.
  3. The maximum number of guests allowed is 40. For more, prior written approval from the board is needed.
  4. Reservations must be made at least ten (10) days prior to the event. Last minute requests with special circumstances will be considered by the Board of Directors. Approval is not guaranteed.
  5. Reservations can be made for the pavilion. The pool and pool deck area cannot be reserved. Access to the pool via the pavilion entrance cannot be blocked or propped open during any event.
  6. The Owner making the reservation is responsible for inspecting the amenity space immediately prior to the event and reporting any damage or cleanliness problems. If possible, photograph the situation and submit it to the management company. This must be presented to the Management Company or a board member the very next business day.
  7. The Owner making the reservation is responsible for leaving the Clubhouse in good condition, removing all trash from the pavilion, wiping down any tables and sweeping the floors if necessary. If the post-event inspection reveals that cleaning or damage, (repair or replacement), is needed, all costs will be billed and must be paid by the Owner making the reservation within two (2) weeks.
  8. Moss Creek Homeowner’s Association is not responsible for personal articles left in or around the Clubhouse.
  9. The Owner making the reservation shall not allow any activity at the event which may endanger the health or unreasonably annoy or disturb or cause embarrassment, discomfort, or nuisance to other Owners or residents, in such a way as to constitute, in the sole opinion of the Board of Directors, a nuisance.
  10. Party and clean up must be complete by 7pm unless prior written approval from the board.
  11. Alcoholic beverages may not be sold. No alcoholic beverages will be served/consumed by anyone under the age of twenty-one. If alcohol will be served at an event and there will be persons under the age of twenty-one (21) attending, the Owner agrees to accept full responsibility for ensuring no underage individuals are served and full responsibility for his attendees and guests’ behavior during and after the event. Further, Owner agrees to indemnify and hold harmless Moss Creek HOA and its Managing Agent against any claims that may arise related to the serving of alcoholic beverages.
  12. No dogs or animals other than those used for special needs will be allowed in the pavilion or pool area. Under no circumstances are pets allowed in the pool.
  13. SMOKING IS NOT ALLOWED IN THE PAVILLION. Candles and tiki torches are not permitted in or around the pool.
  14. The Moss Creek HOA reserves the right to refuse future rentals to an Owner should problems arise as a result of the Owner failing to take reasonable action to maintain control, in the sole opinion of the Board of Directors, at an event he/she sponsors.
  15. In the event you wish to cancel a reservation, please contact the Management Company reservation agent or a board member as early as possible.

I have read and agree to abide by the Moss Creek POA Rules & Regulations with regard to the use of the Amenity/Facility/Clubhouse. I understand that I am responsible for cleaning the premises utilized at the end of my event and that if the premises are not left in a clean manner, or if damages occur my account will be charged a cleaning fee or for necessary repairs. I understand that I am fully and solely liable for any loss or damage caused by such use. I assume all responsibility and will indemnify, defend and hold Moss Creek POA, its Trustees and the Declarant and their employees, agents and contractors, harmless from any and all losses, costs and liabilities related to my use of the clubhouse, including but not limited to reasonable attorney fees.
