Linden Knoll Homeowner's Association, Inc. agrees to lease the Linden Knoll Barn, located at 3604 Rustic Lane, Wilmington, Delaware to the following condominium unit owner/renter for a private event subject to the conditions stated below:

The lessee of the Barn must adhere to the Lease Regulations below:
▪ Be an owner/resident of a unit at Linden Knoll and 21 years or older.
▪ Be present throughout the function including set up and clean up; and vacate premises by 11 p.m.
▪ Event occupancy or attendance is limited to a maximum of ninety-nine (99) people.
▪ Attest no legally prohibited nor profit/money-making activities will be conducted during the term of this lease.
▪ Acknowledge the Barn is private property and has not been modified to provide handicap access.
▪ Agree that in the event the lessee or their guests cause damage or injury to property or persons valued in excess of the deposit amount, the lessee agrees that the Linden Knoll Homeowner’s Association, Inc. is permitted to subrogate claims of loss against any private insurance purchased by or available to the lessee.
▪ Acknowledge the ground area outside the bam (tennis court, pool, picnic area) is common property to the community and cannot be used.
▪ Noise level (music, yelling, etc.) is not to disturb other Linden Knoll residents.
▪ No animals, smoking, open flames/candles, use of fireplace or use of tape/staples on any barn surfaces, are permitted.
▪ Heat or air conditioning temperatures are to be returned to the original setting.

Fees, Deposits, Keys
▪ The rental fee for the use of the lower level only is $125.
▪ A fee of $40 will be charged for any scheduled event cancelled with less than 72 hours notice.
▪ A $100 deposit for all functions is required. This fee will be returned after the facility has been inspected, less an amount for any damage or expense necessary to return the facility to the original condition which includes disposal of all trash in a trash dumpster adjacent to 3602 Rustic Lane (Bldg. 1) at the conclusion of the event.
▪ Two checks are to accompany this agreement (rental fee $125 and security deposit $100).
▪ Council reserves the right to cancel or terminate any event if any Lease Regulations are violated. In such case, the fee and/or deposit amounts will be forfeited.

The Barn key must be returned to the Barn mail slot immediately after the function before leaving the property.

Parking - Guests are to park in the parking areas on the golf course/fairway side of the apartments. It is the responsibility of the owner/host to direct guests to park in spaces on the fairway side of buildings one, five, six, and seven to ensure courtyard parking spaces are available for Linden Knoll Residents. THE SECURITY DEPOSIT WILL BE FORFEITED FOR ANY VIOLATION OF THIS PARKING REGULATION.


I, the undersigned, understand the BARN LEASE REGULATIONS and agree to abide by the conditions contained therein. I understand that the return of my deposit is contingent on the adherence to these lease regulations. Furthermore, I assume responsibility for my guests and any loss or damage incurred during the term of my lease.
