Hilltop Gardens 2024 Parking Lease Prorated


PARKING LEASE

This Parking Lease is made on this the day of , 2024 by and between the Trustees of Hilltop Gardens Condominium Trust c/o FirstService Residential, 3000 Davenport Avenue, Suite 201, Canton, MA 02021 (“Lessor”) and (“Lessee”), who is the owner of at Hilltop Gardens Condominium (the “Unit”). (Hilltop Gardens Condominium is hereinafter referred to as the “Condominium”).

B. LEASE:

Lessor hereby leases to Lessee, and Lessee hereby leases from Lessor, the exclusive right to use one (1) parking space, numbered , (the “Parking Space”) upon the terms and conditions set forth in this Lease. Lessee may park only the vehicle identified in Paragraph A of this Lease in the Parking Space.

C. RENT AND LEASE TERM:

The term of this Lease commences on and expires on August 31, 2025 , (the “Lease Term”). In consideration for renting and using the Parking Space, Lessee shall pay to Lessor $   (the “Parking Assessment”). The Parking Assessment must be paid in full on the day first written above.

D. EXTENSION OF LEASE TERM:

Lessee may request an extension or extensions of the Lease Term (“Subsequent Lease Terms” or “Subsequent Lease Term”). Such requests for an extension or extensions must be made in writing to the Lessor at least thirty (30) days prior to the expiration of the Lease Term or Subsequent Lease Term, as the case may be. The Lessor reserves the right to grant or deny an extension at the Lessor’s sole discretion.

The annual rent for Subsequent Lease terms shall be in accordance with Rule 22 of Condominium Rules and Regulations, as such rule may be amended and in effect at the time of each renewal.

In the event Lessee does not timely request an extension of the Lease Term, Lessee shall be required to cease using the Parking Space after the 31st day of August of the then current Lease Term or Subsequent Lease Term, as the case may be. In the event Lessee continues to use the Parking Space without obtaining an extension of said Lease Term, Lessor may, without notice to Lessee, take all steps necessary to remove any vehicles or property from the Parking Space and shall assess any costs associated therewith, including but not limited to legal fees, towing and storage charges, and lost rent, to Lessee as a common expense assessment secured by the Trustees statutory lien against the Unit referenced above (and/or any other unit in the Condominium owned by the Lessee), in accordance with M.G.L. c. 183A, § 6.

E. PARKING ONLY:

Lessee may use the Parking Space to park one (1) standard size passenger automobile, and for no other purpose. No automobile maintenance, repairs, or washing of automobiles shall take place in the Parking Space. Small pick-up trucks and so-called SUVs used primarily for personal transportation, rather than transportation of commercial cargo, shall be permitted. Commercial vehicles shall not be permitted, but if the vehicle otherwise qualifies under the provisions of this paragraph, the fact that the vehicle may bear a commercial license plate shall not disqualify the vehicle.

F. TERMINATION OF LEASE:

Upon not less than thirty (30) days written notice to the Lessor, Lessee may terminate this Lease. Upon said termination, Lessee is not entitled to a refund of any portion of the Parking Assessment. In addition, there will be no refund if the lease is terminated due to the sale of the unit or expiration of Tenant lease.

G. LESSEE DEFAULT:

Lessee shall at all times during the Lease Term strictly and promptly comply with all applicable laws governing the use of the Parking Space, all rules and regulations promulgated by Lessor and the provisions of the Condominium’s Master Deed and By-Laws, as they may be amended. Lessee shall not injure, overload, deface or otherwise harm the Parking Space; nor commit any nuisance on, in, from or about the Parking Space; nor emit any objectionable noise, vibration, odor, smoke, oil, gasoline, diesel fuel, or vapor from the Parking Space; nor conduct any illegal, illicit or immoral activities in, on, from or about the Parking Space; nor make, allow or suffer any waste of the Parking Space; nor make any use of the Parking Space which is improper, offensive or contrary to law or which will invalidate any of Lessor’s insurance; nor in any way impair or damage the appearance, image or reputation of the Parking Space or the Condominium.

Lessor may without prior notice revoke the parking privileges of Lessee who violates his or her obligations under this Lease, or any amendment hereto, or who otherwise endangers persons or property or creates a safety or health hazard in or about the Parking Space. Lessee is responsible for all persons using the Parking Space. In any situation involving immediate hazard or threat to safety, the Lessor may take the aforesaid actions against such Lessee, remove his or her vehicle or property from the Parking Space or otherwise deny Lessee access to and exclude him or her from using the Parking Space. The Lessor may also avail itself of any other lawful rights and remedies, all rights and remedies of Lessor being cumulative and not exclusive. In the event the services of an attorney are retained by Lessor as a result of any default by Lessee, Lessee agrees to pay the reasonable fees of such attorney.

H. ASSIGNMENT/SUBLEASING:

Lessee may not assign nor sublease the Parking Space in any manner whatsoever except as permitted under the provisions of this paragraph. By prior written agreement with Lessor, Lessee may substitute an automobile other than the one listed in Paragraph A. If Lessee shall rent the Unit, Lessee’s renter may use the Parking Space, provided that Lessee (i) provides Lessor at least fifteen (15) days prior written notice of the rental; (ii) identifies the name and telephone number of the renter; and (iii) identifies the renter’s vehicle in accordance with Paragraph A, above.

I. INDEMNIFICATION:

Lessee agrees to indemnify and hold harmless the Lessor from any or all liabilities arising from the use of the Parking Space, and Lessor shall in no way be responsible for, or liable for, any damage to Lessee or Lessee’s property, including the Vehicle, in connection with this Lease.

J. INSURANCE:

Lessee agrees to maintain his or her own insurance for any vehicle utilizing the Parking Space.

K. CONDOMINIUM DOCUMENTS:

Lessee enters into this Lease subject to the Master Deed, Condominium Trust, and Condominium Rules and Regulations, including amendments thereto, and the provisions of G.L. c. 183A. The Lessor shall have the right to amend said Condominium documents from time to time.

L. JOINT AND SEVERAL LIABILITY:

If the names of more than one Lessee appear in the Lease, or on the signature lines of this document, then each person so named shall be jointly and severally liable to the Lessor for all of the covenants and agreements in this Lease.
