 Rental Rules and Procedures

 

  1. The Amenity Center is open for the use by members of the Amenity Association in good standing and their accompanied While the Amenity Center may be reserved for private functions, private owner events will NOT include access to the workout facility which will remain open to the community. The pool area itself may not be reserved. Events should be confined to just the amenity building. Any group with 10 or more individuals will have to reserve the amenity center to hold any type of function.
  2. Community-wide events will be scheduled and held from time to time at the facility, and private events may be scheduled by members on a first come/first served space available The hosting property owner must be in attendance at any scheduled event.
  3. ALL private events must be scheduled through Etiwan Amenity c/o First Service Residential 201 Sigma Dr. Suite 350 Summerville, SC 29486   Phone: (843) 795-8484
  4. Scheduling of such an event will require the payment of the usage fee of $200. Furniture arrangement and the facility must be left in the condition in which it was found. Those renting the facility must provide their own tables for their events (tables not provided). Pool-side tables and/or chairs may not be brought into the Amenity Center for private parties. All garbage generated must be bagged and removed from the premises. Those renting the facility must clean the facility after use and all trash removed.
  5. The renting owner must contact FirstService Residential the morning of the event to report any damage found prior to their event. Any damage noted after the event will be charged to the owner. Balloons, if used, must be secured in such a way that they do not become loose and float to the ceiling as they may become entangled in the ceiling fans and damage the motor. If balloons require a service call to retrieve them from the ceilings or fan motors, the cost of the service call will be charged to the owner. Doors should not be blocked or propped open at any time.
  6. **** All applications and fees must be received at the Association Office within 5 (five) business days of booking in order to confirm your reservation. Reservations will automatically be canceled without receipt of the application and fees. HOA-sponsored social functions will have priority over private events.
  7. The property owner (lessee) agrees to and understands that this is a family-oriented facility and any infractions or deviations from family-oriented themes, activities and/or guest behaviors will result in an immediate termination of the event AND application of a fine of $250 per infraction, per guest in attendance. Owner certifies by acceptance of this lease his/her agreement with the reasonableness of this provision and penalty. Examples of specific violations of this section will include “bachelor/bachelorette” party themes, “adult” events and any other event theme where young children would not ordinarily be invited or in attendance.
  8. The property owner (lessee) agrees to and understands that this facility may not be used to hold any political events, including campaigns, demonstrations, rallies, or fundraisers.
  9. The property owner (lessee) agrees that he/she will not allow consumption of alcoholic beverages or any other intoxicating substance to any such degree that it would result in impairment, nuisance to other users of the facility or the pool and playground area. Further, the owner agrees to actively monitor impairment and immediately cease, correct and transport impaired individuals off the property by an unimpaired designated driver. Violations of this section will result in immediate termination of the event AND application of a fine of $250 per infraction, per guest in attendance.   10. In accordance with SC DHEC laws and for safety of owners and their guests, ALL exterior doors and gates must be kept closed and latched at all times.
  11. Events may not be scheduled earlier than 9:00 AM. Normal closing hour for clubhouse functions shall be 10:00 PM
  12. Persons occupying the facility after hours, who trigger an alarm event, or whose failure to properly secure the facility allows the triggering of an alarm will be charged a fee for time, travel, and costs at a rate to be

  14. Neither the community management company nor the HOA assumes any liability for personal injury to or for the loss of personal property of property owners or their guests.
  15. The HOA and community manager reserve the right to refuse use of the facility by any group or organization whose size is likely to strain the facilities or constitute a hazard in the event of fire or other emergency.
  16. SMOKING IS NOT PERMITTED INSIDE THE BUILDING AT ANY Smokers outside the building are requested to dispose of their cigarette butts properly.
  17. By order of the Fire Marshall, no grilling, grease cooking or deep frying will be allowed in the building or in or near any pine straw or mulch areas.
  18. Host agrees to respect the “quiet enjoyment” of the residents of the community.
  19. No one under the age of 21 may reserve the facility.
  20. No pets are permitted within the facility at any time.
  21. No fireworks of any kind are permitted at or near the facility at any time.
  22. No for-profit events are allowed.
  23. No loitering in the Parking area.

I have read and agree to abide by the Etiwan Pointe Amenity Rules & Regulations with regard to the use of the Amenity/Facility/Clubhouse. I understand that I am responsible for cleaning the premises utilized at the end of my event and that if the premises are not left in a clean manner, or if damages occur my account will be charged a cleaning fee or for necessary repairs. I understand that I am fully and solely liable for any loss or damage caused by such use. I assume all responsibility and will indemnify, defend and hold Etiwan Pointe Amenity its Trustees and the Declarant and their employees, agents and contractors, harmless from any and all losses, costs and liabilities related to my use of the clubhouse, including but not limited to reasonable attorney fees
