Swimming Pool and Fitness Room - Assumption of Risk Agreement

SECTION 1 — RESIDENT INFORMATION

SECTION 2 — Participating Individuals

List all individuals who will be using the Facilities. You accept responsibility for their compliance with all facility rules.

SECTION 3 — ACKNOWLEDGMENTS  (Initial Each Paragraph)

Read carefully before initialing. By initialing each paragraph and signing below, you agree to the following on behalf of yourself and all persons listed above.

1. ) I acknowledge that use of the Facilities - including the swimming pool and fitness room - involves inherent risks of physical injury, disability, death, and property or economic loss. These risks may arise from the condition of the Facilities, the actions of other users, or my own conduct and that of my guests and other persons under my supervision. I understand that swimming pools and fitness rooms are inherently dangerous and voluntarily assume the risks that I and my guests and other persons under my supervision may be endangered by entering and using the Facilities. I further acknowledge that such use of the Facilities may result in illness, disability, or death. I also understand that the risk of becoming injured at the Facilities may result from the behavior, actions, or negligence of others that are beyond the Associations' reasonable control, including but not limited to other patrons or members, and their families and guests. 

2. ) I acknowledge that the Associations and their agents, including American Pool, LLC with respect to pool operations, cannot guarantee a risk-free environment. The Associations have implemented reasonable safety measures and operating procedures, but do not guarantee the elimination of all risk. This includes risks related to communicable illness, physical hazards, and the conduct of other users.
   
   

3. ) I represent that neither I nor my guest or any person under my supervision is currently experiencing symptoms of illness, including fever, cough, respiratory symptoms, or gastrointestinal illness. I agree that if any such symptoms develop while at the Facilities, we will leave immediately and notify the Associations' Management Agent. I further represent that I and my guests and persons under my supervision will not enter or use any part of the swimming pool or fitness room at any time unless we are in good health and have no physical or other impediment that would create a danger to myself, themselves, or others while using the Facilities.

4. ) I confirm that I have reviewed the pool and fitness room rules with my guests and all persons under my supervision and agree that we will comply with all posted rules, lifeguard instructions, and Association guidelines at all times. I understand that non-compliance may result in suspension or revocation of facility access.

5. ) I acknowledge that supervision is required of all visitors and users of the Facilities, regardless of age. This applies to the pool and fitness room at all times. Key cards are non-transferable - any facility access using my key card is my sole responsibility. I will not permit unsupervised individuals to access the Facilities using my credentials.

6. ) I understand that by signing the pool sign-in log at each pool visit, I and my guests reaffirm acceptance of these terms for that visit. No additional assumption of risk form is required at each visit, provided this agreement remains on file.
   
   

7. ) I understand that I may be denied access to the swimming pool and/or fitness room if I decline to sign this agreement, or if my key card has not yet been activated. Key card activation requires a completed agreement on file with the Management Agent.

SECTION 4 — SIGNATURE

By signing below, I confirm that I have read this entire agreement, that I understand its terms, and that I agree to be bound by them on behalf of myself, my guests, and all persons under my supervision. For any person below 18 years of age, this document is binding to the extent allowed by law. I acknowledge that this is a legally binding document. To the extent any portion of this Agreement is adjudged unenforceable by a  court of competent jurisdiction, I agree that the remaining provisions of this Agreement shall nonetheless survive and remain in full force and effect.
