CLEAR CREEK OWNERS ASSOCIATION
CLUBHOUSE RENTAL AGREEMENT
APPLICATION AND PAYMENTS MUST BE RECEIVED BY HOA MANAGEMENT AT LEAST 2 WEEKS PRIOR TO THE
RESERVATION DATE – RESERVATIONS WILL NOT BE ACCEPTED LESS THAN 2 WEEKS PRIOR TO REQUESTED DATE
CLUBHOUSE RULES AND REGULATIONS
1. A pre-event walkthrough by a representative of the Association will be accomplished prior to the event, and a post-event walk through will be completed within twenty-four (24) hours or prior to the next-scheduled event, whichever comes first. Items left at the clubhouse after the final walk through become the property of the Association.
2. Everyone shall vacate the clubhouse no later than 10:00 PM on the date of the event.
3. No paint, tape, nails, or screws are allowed on walls or ceilings. All helium balloons must be removed from the clubhouse when the event is over. If balloons are left inside the clubhouse after the event the deposit will not be returned.
4. Clubhouse furniture is to remain inside and cannot be moved to any other area of the clubhouse.
5. One adult must be present for every eight persons when the age group averages 18 years old or younger.
6. Alcoholic beverages are ONLY permitted with the receipt of a “One Day – Event Insurance Policy”. The Resident assumes all liability and shall ensure consumption is only by persons 21 years of age or older. The sale of alcoholic beverages is prohibited at the clubhouse or any amenity area.
7. All music must cease at 9:30 PM.
8. Wet swimwear and/or clothing is not permitted inside the clubhouse.
9. Smoking is not permitted inside the clubhouse or at any amenity of the Association.
10. Resident is responsible to control the noise of his/her guests.
11. Resident is responsible to control the parking of his/her guests. All vehicles shall park in designated parking spaces only. No parking on the grass or in front of mailbox units.
12. Resident is responsible for the conduct of his/her guests and invitees and shall be held liable for all damages caused by his/her guests and/or invitees.
13. As part of the required clean up, all food and trash must be removed from the clubhouse and properly discarded. All tables, counters, appliances, and floors should be wiped down and swept clean.
14. All furniture must be returned to its original location and thermostat reset to “program” mode.
15. All doors and windows must be locked before exiting the clubhouse.
16. All HOA fees must be paid in full to submit a reservation application and applicable rental fees.
17. Failure to comply with these terms may result in a forfeiture of all or a portion of your security deposit as
determined by the Association.

(If you answered “Yes” to the above question you MUST obtain a “One Day – Event” Insurance policy for the date of the event. This policy must be received by the Management Company no later than one week prior to the event. If the policy is not received in this time the rental will be canceled. )
In consideration for the Clear Creek Owners Association allowing me the exclusive use of the Clear Creek clubhouse and equipment and furnishings, I, the undersigned, agree as follows:
1. I agree to reserve the clubhouse of the Clear Creek HOA on , between the hours of 8:00 AM – 10:00 PM, under the terms and conditions set forth below.
2. I am reserving the clubhouse for the purpose of which will be attended by not more than 40 people. This will be a "not for profit" function and in no way benefit my family or me financially.
3. I have paid all HOA fees and do not have a delinquent balance.
4. I understand that continued use of the clubhouse after the day of rental will constitute a breach of this agreement and will result in forfeiture of my deposit.
5. I will make a payment in the amount of $70.00 for the rental. The fee will be made payable to Clear Creek Owners Association, Inc. I acknowledge a fee of $200.00 for a refundable deposit will be charged to my account at the time of the rental. The Association reserves the right to collect the deposit if any damages are found during the post rental walkthrough. The rental fee must be RECEIVED by the Management Company at least two weeks before the rental date.
6. I further understand and agree that the refundable deposit for damages, will be used to pay any necessary cleaning cost and any and all damages resulting to the clubhouse, its contents, or any other portion of the property from any actions of persons present at, or attending, or in any other way related to my function. I understand that any charges made against my refundable deposit for damages will be explained. If the cost of repairs exceeds the amount of my deposit, I agree to pay the Association the full cost of all repairs within fourteen (14) business days of receipt of a written explanation of the damages and a bill from the Association for such repairs. I agree that all deposits, fees, and expenses incurred by the Association as a result of the use of the clubhouse under this agreement shall be fully collectible as provided for in the Association's governing documents.
7. I assume all responsibility, risks, liabilities and hazards incidental to the activities applied for (including, but not limited to, the serving of alcoholic beverages), and hereby release and forever discharge the Association, its officers, directors, employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability for personal injury or death and damage to or destruction of property arising from my use of the clubhouse and its appurtenances.
8. I agree to indemnify and hold harmless the Association, the contracted HOA management company, its officers, directors, employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability (including, but not limited to, attorneys fees) for any injury, to either person or property, suffered by me, my family members, employees, agents, servants, guests, invitees or any member of the Association or any other person which arise from or are in any way related to the above activity, whether or not caused by the Association's negligence.
9. I assume all responsibility for the actions and behavior of all persons present at, attending, or in any other way related to my function and agree to be personally responsible for causing all such persons to comply with the Association's Declaration, By-Laws and Rules and Regulations. I acknowledge that violation thereof by any person present at, attending, or in any other way related to my function, may, at the sole discretion of the Association's Board of Directors result in forfeiture of my refundable damage deposit.
10. I understand that I am being granted the exclusive use of the clubhouse for the time period described above subject to the right herein reserved by the Association to enter the clubhouse and terminate my use thereof should the conduct of any person using the facility endanger the health, safety or wellbeing of any person or constitute a threat of damage to Association Property.
11. I am at least eighteen (18) years of age and will be in attendance at my function. I hereby agree and represent that the clubhouse will be used for lawful purposes only and that if any conduct at the function I am sponsoring violates federal, state, or local laws or ordinances, my rights to use the clubhouse under this Agreement shall be terminated and the Association shall have the right to take possession of the clubhouse and instruct my guests to leave the property.
12. I agree to clean the facilities after use which includes all surfaces wiped clean, all trash to be removed and properly discarded.
13. I understand that this reservation allows for the use of the clubhouse ONLY and does not include the use of the swimming pool and/or pool deck area, playground, and fitness center. At no time should attendees from the event enter the pool and/or pool deck area or fitness center. The reservation does not include exclusive use of the bathrooms. Bathrooms will remain open for use for the rental attendees as well as residents using the pool and fitness center.
14. I understand that my reservation is not confirmed until the completed application and payments have been mailed, received, and confirmed by the contracted HOA management company. If application and payments are not received at least 2 weeks prior to the reservation date, I understand that my reservation will be forfeited.
15. I have carefully read and understand this form and the attached rules and agree to be bound by its terms and has caused
this agreement to be executed as of the date indicated below.
