This rental agreement is for a private social event sponsored by a Carolina Reserve HOA member for exclusive access of the Clubhouse.

ACKNOWLEDGEMENTS

I acknowledge receipt of the clubhouse rules and regulations and understand they are subject to change without notice.

I agree to abide by the clubhouse rules and usage agreement.

I agree to adhere to the Carolina Reserve Clubhouse cleaning checklist below*.

I understand that infractions or violations of these rules by myself, any member of my family, or by anyone of my guests gives cause for the Association Management or a member of the Board of Directors to dismiss any member of the above-mentioned persons from the amenity property of Carolina Reserve for the remainder of the day, or for an extended period of time as specified by the Board of Directors.

My household, my guests and I agree to respect The Carolina Reserve HOA, Clubhouse and all property and equipment contained therein and will not damage or abuse the facilities, property or equipment in any way. I agree to pay all costs of any missing property or damage caused by my household, my guests or myself.

My household, my guests and I agree to act in accordance with any rules, requirements or recommendations, as set forth by the Carolina Reserve Homeowners Association, Inc. in relation to the health and safety of all residents and the enjoyment in use of the facilities to which each resident has a right.

Any violations of items above by any family member or one of their guests give cause for The Carolina Reserve HOA, Inc. to fine and/or suspend or revoke amenity privileges.

I understand that no person who has had his or her privileges suspended or revoked may be a guest in the Clubhouse.

I understand parking facilities in the lot adjacent to the Clubhouse are to be used only when using the amenities.

I understand that no guests are permitted to park on any street in the community.  All guests must be parked in the clubhouse parking lot. Failure to comply may result in forfeiture of deposit.

I understand that only one event per day is permitted to be scheduled, and scheduled community events take a priority over private events.

The undersigned hereby:

Releases and waives all claims against the Developer of Carolina Reserve, the Board of Directors of the Carolina Reserve Homeowners Association, Inc., its management company, employees, attorneys, successors and the Carolina Reserve Homeowners Association, Inc. to the full extent permitted by law, for death, personal injury or damage to property sustained directly or indirectly by the undersigned or any one in any way related to or affiliated with the resident.

Assumes complete financial responsibility for the event and agree to indemnify and hold harmless, the Developer of Carolina Reserve, Board members, management company, employees, attorneys, successors to and the Carolina Reserve Homeowners Association, Inc. to the full extent permitted by law, against any and all claims, damages, suits, expenses (including attorney’s fees) brought by any third party for death, personal injury or damage to property resulting from the use of the facility. (Exception: no financial responsibility for Carolina Reserve Social Committee Events).

Understands that he/she will not be using the pool and surrounding areas within the pool fence at the pool level as the POOL IS CLOSED to guests attending the Clubhouse event.

Member acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that Member may be exposed to or infected by COVID-19 while on site at the HOA’s common areas and amenities, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. Member acknowledges that the risk of becoming exposed to or infected by COVID-19 at the HOA amenities may result from the actions, omissions, or negligence of Member and others, including, but not limited to the HOA Board and Officers; and First Service Residential (the HOA’s management company), and their employees, officers, directors, agents, and representatives. Member agrees and accepts, on his or her behalf and on behalf of all persons in Member’s household and guests, that the use of the HOA’s common areas and amenities may expose Member to heightened risk for COVID-19. Member assumes the risks associated with the use of the common areas and amenities and exposure to COVID-19. Member agrees to take all precautions to protect Member’s health or safety.

In consideration of the HOA’s consent to use of the HOA’s common areas and amenities, the undersigned hereby agrees to indemnify, hold harmless and release the HOA and its officers, directors, employees, agents, contractors, successors and assigns, from any and all claims, damages, or liability arising out of or connected in any way with the use of the common areas or the amenities arising from exposure to COVID- 19 or any illness or disease connected with COVID-19.

Member acknowledges that he/she accepts full responsibility to ensure that all rules and regulations established by the HOA are followed by all guests/invitees, and that Member will strictly abide by all federal, state or local guidance regarding COVID-19, including rules or guidance promulgated by the CDC or other governmental agencies, along with social distancing requirements. Member and other users of the common elements and amenities will be responsible for providing their own sanitizer and for ensuring that any property is sanitized before and after use. HOA may establish additional rules or regulations, and it is Member’s responsibility to be informed about and comply with such rules or regulations. Member is at least 18 years of age and competent to execute this Agreement. Should any portion of this Agreement be declared invalid by a court of competent jurisdiction, the remainder shall remain enforceable in accordance with its terms.

This Agreement shall remain effective for so long as COVID-19 risks or restrictions are in place throughout the United States. Notwithstanding, HOA may, in its sole and absolute discretion, prohibit all access to the HOA’s common areas and amenities at any time, which prohibition shall not limit the terms or conditions in this Agreement.

CAROLINA RESERVE HOA, INC. CLUBHOUSE RENTAL CLEANING CHECKLIST* 

Failure to follow this checklist may result in charges to the owner’s ledger and or suspension of amenity access.

Food or beverage dropped on the floor or furnishings should be cleaned immediately. 

Carpets vacuumed and stain free. 

Countertops and tables wiped clean. 

Furniture clean and in good repair and left in correct positions. 

Kitchen floors clean. 

Kitchen sinks and appliances clean. 

Refrigerator has been emptied. Anything left in the refrigerator becomes clubhouse property. 

No food containers or utensils should be left on counters, in drawers, or in refrigerator. All food and beverages removed from the main room, kitchen, and bathrooms. 

All event decorations have been removed. 

Place trash in receptacles provided. At the end of the event remove all trash and recycling from the clubhouse including the kitchen and restroom trashcans and separate the garbage and recycling, placing them in the correct outside containers. 

Exterior clean and litter free. 

Interior walls clean and unmarred. 

All lights and bathroom fans to be turned off. 

Make sure the room temperature is restored to Run Program button if temperature has been adjusted. 

Report any pre-event checklist concerns to FirstService Residential by calling 1-855-54MYHOA (1-855-546-9462) before the start of your event.

Immediately following your event report any post-event damage or non-compliances to FirstService Residential by calling 1-855-54MYHOA (1-855-546-9462).

Application and Payment Instructions.

Rental fee of $100 must be paid at time of reservation.

Report any pre-event checklist concerns to First Service Residential by calling 1-855-54MYHOA(1-855-546-9462) before the start of your event

Immediately following your event report any post-event damage or non-compliances to FirstService Residential by calling 1-855-54MYHOA(1-855-546-9462).

Damage deposits are not required. The board of directors and or the clubhouse committee chair will inspect for damage and the owner will be charged for damages, repair and labor on their resident ledger. Payment will be due when charges post to the owner’s ledger.

I understand that by signing this agreement I acknowledge receipt of rules, waive liability and consent to the damage deposit policy.
