I, (Applicant), would like to rent the Breckenridge Club House on , for the purpose of and for no other purpose. The hours of use shall commence at 7:00 AM and concludes at 11:30 PM.

The fees for Club House/Facility rental are (two separate payments):

• A $200 security (Separate check or money order)
• A $250 per calendar day rental fee. The rental fee shall be non-refundable if the event is cancelled less than 48 hours prior to the scheduled rental date. Checks payable to Breckenridge POA. (Separate check or money order)

The Applicant by his/her signature affixed below declares:

1. That Applicant is a current property owner or authorized tenant and is in good standing with the Breckenridge Property Owners Association (POA) (i.e., all assessments are paid in full and there are no covenant violations).
   1. Authorized tenant must have this form signed by Homeowner providing permission and accepting liability of damages.
2. That Applicant will be present during the event and responsible for:
   1. any damage (damage includes but is not limited to destruction to facility and fixtures, interior or exterior, spills or burns on area rugs) to the premises caused by Applicant, their guests, affiliates, agents or employees.
   2. The behavior of themselves, their guests, affiliates, agents or employees.
3. That usage will not be for any money-making purposes. 
4. That occupancy of the building will not exceed 73 individuals
5. That Applicant hereby releases the POA from any and all damages, action, claims, injury, or causes of actions made by Applicant, their guests, affiliates, agents or employees.
6. That all noise ordinances set forth by the county will be (website needed)
7. No loitering of guests is permitted in the parking lot.
8. That Applicant agrees to leave the premises in good and clean condition, removing all trash from the interior and exterior of the premises so that it is left in the same condition as prior to applicant's use. Leaving trash inside or outside the building will incur $25 per bag charge from the security deposit, as trash left on the interior leaks and causes odor, and when left outside is tom apart by animals and spread through the All cleaning supplies and trash bags must be supplied by the Applicant. Please see 18 for related cleaning fees.
9. Applicant may enter the clubhouse as early as 7am, and the event must end and the property vacated by 1130pm.
10. The security deposit will be returned only after a final inspection of the facility has been completed; and as appropriate, keys returned.
11. Applicant agrees any infraction of these rules will result in a deduction from, but not limited to, the total amount of the cash Amount will be determined by the management agent for the POA.
12. SMOKING/VAPING AND DRUG USE OF ANY KIND IS NOT PERMITTED IN THE CLUBHOUSE.
13. All furniture is to be returned to its original placement prior to leaving,
14. No red beverages may be served.
15. If a key is provided for access to the club house it shall not be duplicated. Duplication of the key will result in suspension of all amenity usage rights for the Applicant and their Failure to return the key at the agreed upon time will result in a $60.00 charge.
16. The facility thermostats will not be Adjustment of the thermostats will be cause for a portion and/or all of the damage deposit, depending on the circumstances, to be withheld. The thermostat shall be kept at 70 degrees year-round. There will be a $50 electricity charge if the thermostat has not been kept at the above indicated temperature.
17. Access to the pool during Rental Day is determined upon current guest policies of the pool. ACCESS TO THE POOL AND DECK IS STRICTLY PROHIBITED WHEN THE POOL IS CLOSED. Your failure to comply with this will result in forfeiture of your deposit and may result in permanent suspension of your ability to utilize the clubhouse.
18. Cleaning fees will be assessed based on the condition of the clubhouse upon exit inspection. Fees will be assessed in hour increments of $50/hour and a minimum of 1 (one) hour charge. The cleaning fee will be deducted from but not limited to the total security deposit provided.
19. A POA Management representative will conduct Before and After Checklists to ensure all policies listed above are adhered to. The representative may enter the clubhouse several days in advance of the scheduled event for check in and up to 72 hours after the conclusion of your event for check out. It is highly encouraged to take pictures before and after your event.  If there any concerns upon check in, please reach out to your rental contact.

You agree to indemnify and hold Breckenridge POA and First Service Management, harmless from and defend against, and shall reimburse the same with respect to any and all loss, damage, liability, costs, and expenses, including reasonable attorneys' fees at all judicial levels, from any claim, cause or action whatsoever, incurred by reason or of arising out of or in connection with (a) any damage to the Breckenridge Club House/Facility caused, directly or indirectly, by you or any of your affiliates, agents or employees, or (b) injuries to persons or property caused, directly or indirectly, by you or any of your affiliates, agents or employees while on Breckenridge POA property. The provisions of this paragraph shall survive the termination of this Agreement.
