BAYLAND CONDOMINIUM
CLUBHOUSE RESERVATION AGREEMENT


I, , OF BAYLAND DRIVE, , DO HEREBY REQUEST TO RESERVE THE CLUBHOUSE ROOM FOR A PRIVATE EVENT ON , FROM A.M. /P.M. UNTIL A.M./P.M.
THE EVENT TO BE HELD IS FOR .
NUMBER OF PEOPLE ATTENDING (NOT TO EXCEED 50 PEOPLE) .
WILL THERE BE AN ALTERATION TO THE AREA (NO NAILS OR PERMANENT HOLES ARE TO BE MADE ON ANY WALL IN THE CLUBHOUSE. NO TAPE IS TO BE USED ON ANY SURFACE WITH WALLPAPER).


THE FOLLOWING TERMS AND CONDITIONS SHALL APPLY:
1. DURING THE TIME RESERVED FOR THE EVENT THE UNIT OWNER WHO’S SIGNATURE APPEARS ON THIS DOCUMENT, MUST BE PRESENT AT ALL TIMES.
  2. SAID UNIT OWNER IS SOLELY RESPONSIBLE FOR THE ACTIVITIES OF ALL GUESTS IN ATTENDANCE AND ANY DAMAGES OR INJURY THAT OCCURS IN THE AREA RESERVED DURING THE TIME OF THE RESERVATION.
  3. THE CLUBHOUSE COMMITTEE IS AUTHORIZED TO IMPOSE ANY REASONABLE CONDITIONS, IN ADDITION TO THOSE NOTED HEREIN, UPON RESERVATION CONFIRMATION OF THE CLUBHOUSE. DECISIONS OF THE CLUBHOUSE COMMITTEE
ARE FINAL. NO OTHER PERSONS ARE AUTHORIZED TO MAKE ANY REPRESENTATIONS REGARDING RESERVATION OF THE CLUBHOUSE, INCLUDING THE BOARD OF DIRECTORS OR EMPLOYEES OF FIRSTSERVICE RESIDENTIAL.
  4. THE UNIT OWNER AND ALL INVITEES ARE ENTITLED TO THE EXCLUSIVE USE OF THE UPSTAIRS OF THE CLUBHOUSE ONLY (THIS DOES NOT INCLUDE THE SWIMMING POOL AREA) AND ONLY FOR THAT TIME WHICH THEY HAVE RESERVED ACCORDING TO THIS AGREEMENT.
  5. IF THE UNIT OWNER DESIRES, APRE-EVENT INSPECTION CAN BE ARRANGED WITH A CLUBHOUSE COMMITTEE MEMBER. DURING THIS INSPECTION ANY PRE-EXISTING CONDITIONS MAY BE NOTED.
(I WISH TO ARRANGE A PRE-EVENT INSPECTION FOR DATE/TIME)
  6. AFTER THE EVENT, THE CLUBHOUSE COMMITTEE WILL INSPECT THE CLUBHOUSE FOR THE CONDITION OF THE AREA BY 10:00 AM THE NEXT DAY AND NOTIFY THE UNIT OWNER OF ANY CONDITION NEEDING CORRECTION.
7. A MAXIMUM OF FIFTY (50) PERSONS ARE ALLOWED AT ANY EVENT.
  8. IN THE EVENT THAT DAMAGE IS CAUSED TO THE PREMISES WHICH IS REASONABLY BELIEVED TO HAVE OCCURRED AS THE RESULT OF THE RESERVATION AND THE COST OF REPAIRING THE DAMAGE IS GREATER THAN THE AMOUNT OF THE RENTAL, SAID AMOUNT SHALL BE COLLECTIBLE IN THE SAME MANNER AS ANNUAL CONDOMINIUM ASSESSMENTS.
PURSUANT TO ARTICLE VII, SECTION R OF THE BAYLAND CONDOMINIUMS, INC. BY-LAWS, ANY VIOLATION OF THE RULES SET FORTH HEREIN OR THOSE PROMULGATED BY THE BAYLAND CONDOMINIUM, INC. BOARD OF DIRECTORS, OR THOSE CONTAINED IN THE BY-LAWS OF THE BAYLAND CONDOMINIUMS, INC. SHALL APPLY TO THE EVENT.
  9. DURING THE EVENT, A MEMBER OF THE CLUBHOUSE COMMITTEE OR THE BAYLAND BOARD OF DIRECTORS, OR THEIR DESIGNEE, MAY MONITOR THE EVENT. THE UNIT OWNER MUST COMPLY WITH ALL REQUESTS MADE BY SAID INDIVIDUAL.
10. THE UNIT OWNER UNDERSTANDS THAT THIS AGREEMENT IS NOT VALID UNTIL A CHECK IS RECEIVED AND THIS AGREEMENT IS SIGNED BY A CLUBHOUSE MEMBER.


I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE TERMS OF THE CLUBHOUSE RESERVATION AGREEMENT AND HEREBY REQUEST A RESERVATION OF THE ABOVE PREMISES FOR THE STATED DATE AND TIMES PURSUANT TO THE TERMS HEREIN.

THE FOLLOWING RULES FOR THE CLUBHOUSE ARE TO BE OBSERVED CONCURRENTLY WITH THOSE AGREED TO IN THE RENTAL/RESERVATION AGREEMENT
1. Unit owners are solely responsible for the actions and conduct of their invitees and guests, and any and all damage caused by themselves, invitees or guests. Should a disturbance, misconduct, or other major problems occur that is beyond the control of the Unit Owner, the Unit Owner must contact the police and Management Company immediately and/or a member of the Board of Directors; and based on the severity of the problem as described the management company or board member in conjunction will take whatever action necessary to resolve the problem.
2. It is the responsibility of the Unit Owner to immediately report any and all damage to the Clubhouse Committee or Board of Directors who will report said damage to the Management Company within eighteen (18) hours of the damage.
3. When the Unit Owner rents the Clubhouse (THIS DOES NOT INCLUDE THE SWIMMING POOL AREA), the Clubhouse Committee will conduct an inspection with the Unit Owner of the area(s) to be rented before the rental to establish the condition of the said area(s) and note any existing damage. Also, the Clubhouse Committee will conduct an inspection of the rented area(s) by 10:00 a.m. on the day after the rental. If new damage is found, the Unit Owner will be contacted immediately, and an estimate of the damage secured using the deposit as collateral. Failure on the part of the Unit Owner to pay for the damage will result in a lien placed on the Unit Owner’s condominium unit, loss of privileges, and any other possible actions to be taken by the Board of Directors as they deem necessary until the said lien is satisfied.
4. After each rental, it is the responsibility of the Unit Owner to clean the area(s) used, performing general housekeeping duties and to dispose of all trash in a dumpster. Rules are posted on the wall in the kitchen area. The kitchen is to be left in the same condition as it was found prior to the rental. CATERERS ARE TO BE INFORMED OF THIS PRIOR TO THE START OF THE RENTAL EVENT. Failure of the Unit Owner to comply will result in action being taken by the Board of Directors using the deposit as collateral or as deemed necessary to return the area(s) to its original condition.
5. A fine up to the amount of the deposit/rental may be levied against the Unit Owner renting the Clubhouse by the Board of Directors for infractions of the rental contract and in particular for infractions of the stated hours of the rental, which includes clean up time.
6. Pets are not permitted in the Clubhouse.
7. Requests for any precarious and/or outdoor activities must have prior approval from the Board of Directors.
8. Excessively loud music or noises that would disturb Unit Owners close to the Clubhouse is prohibited.
9. Smoking is prohibited anywhere inside the Clubhouse including the restroom areas.
10. No crab feasts are to be held inside the Clubhouse and no storage of food in the refrigerator is allowed before or after the rental date.
11. No nails or permanent holes are to be made on any walls in the Clubhouse. No tape is to be used on any surface with wallpaper.
12. Activities in the Clubhouse may either rented, schedules or used from 8:00 a.m. to 11:00 p.m. on a daily basis. During all other times, the Clubhouse will be secured unless specifically rented or other arrangements are made with the Clubhouse Committee. All rentals will be assisted by the Clubhouse Committee and exceptions to the above times must be prior approved by the Committee.
