3rd Party Agent Authorization


Dear Property Owner,

Some property owners consider directing their Homeowners Association to send all mailings (billings, violations notices, legal and meeting notices, newsletters, etc.) to the rental agent. Association Boards firmly believe that direct owner communication assists in getting HOA accounts paid timely to prevent the application of late fees, filing of liens, and other related legal and collection matters.

Please be reminded that the property owner, not the rental agent, will be held ultimately responsible for renters' actions, regardless of who collects the rent.

Boards respectfully remind you of the importance of providing the renters with the Governing Documents and explaining the necessity for compliance. They also suggest that all leases have provisions for the collection of HOA fines and fees from their tenant and an acknowledgment that tenants have read and understood the Covenants and Rules and agreed to abide by them, similar to the acknowledgment all owners made at the closing table. Your Board shares your goal of enhancing property values in the community, which is best served by working with you.  If after considering this information you still wish to maintain your rental agent as your sole HOA contact, (note that management and the Association will only contact your rental company) we will honor this request if it is made by signing this document with your personal endorsement below. We regret any inconvenience, however, we hope that you understand the reasons for your Association’s strong position.

3Rd PARTY AUTHORIZATION AND MEMORANDUM OF UNDERSTANDING

 

I,  as the legal owner(s) of the property located at   within   (Association) have reviewed and considered the information above and desire to have my address of record changed with the Association to my rental agent, (Agent) at . I hereby designate Agent as my lawful Power of Attorney and acknowledge my understanding that Agent will receive any and all future billings, notifications, proxies, and correspondence for me relating to the Association. I will personally direct them on proxy and quorum matters and will fully accept and acknowledge delivery of all Association-related correspondence sent to the Agent as if delivered to me personally, for all purposes relating to Association business.
