ANTIQUITY-CORNELIUS POOL

SWIM AT YOUR OWN RISK WAIVER

 

Again in 2026, from Saturday Ma 2, 202 through the official closing of the Antiquity regular Pool season on Sunday September 27, 2026, LIFE GUARDS WILL NOT BE PRESENT, and we will be requiring a liability waiver to be signed by all residents in order to gain access to the Antiquity pool.

For your key fob to be activated for the 2026 Season, The Pool Rules and Swim At Your Own Risk Waiver Forms must be signed by EVERY adult 18 or over that resides at the Homeowner's address.

 

I, acknowledge that my family and I, residing at :

A. Voluntarily agree to participate in the Antiquity SWIM AT YOUR OWN RISK program at the community pool located at Lovers Lawn Trace, Cornelius, NC 28031.

B. Will ensure that anyone under the age of 16 from my household, or guests of my household will be accompanied and watched by an individual 16 and above.

C. Agree that anyone from my residence, or guests of my residence, using the pool are able to willingly verify their age if requested. 

D. Agree to keep any music at a low volume so as not to disturb nearby neighbors or others at the pool.

E. Will assume all responsibilities for any member of the family or guests of the family and ensure compliance of all Pool Rules. 

F. Agree not to open the gate to allow anyone into the pool area. Everyone entering the pool area must use their HOA provided key fob to access the gate.

G. Agree to all HOA Pool Rules and pool hours of operation. 

H. Acknowledge that failure to comply with all Pool Rules as distributed by the HOA can result in suspension or revocation of access to the pool for the remainder of the Pool Season.

This Liability Release and Acknowledgement ("Release") is made on the date noted below by the undersigned member(s) of the Antiquity-Cornelis Community Association ("Association") in favor of the Association, its officers, directors, pool committee members, agents, managers, employees, and members (collectively the Association Released Parties). 

In consideration of the Association allowing me or my child or ward under the age of 16 to participate in the use of its swimming pool and facilities during the Pool Season, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, each of the undersigned, on behalf of himself or herself and, if applicable, acting as parents and/or guardians for his/her/their child or ward, hereby agrees and acknowledges as follows:

1. I, acting in my individual capacity and/or as a parent or guardian for a minor child or ward, hereby acknowledge that I understand all of the Association “Pool Rules” as well as the additional rules stated above (A-H) and agree to strictly adhere to all provisions, conditions and requirements contained therein. I further agree that it is my sole responsibility to make certain that all other persons admitted by me, my children, my ward(s) thereof are also made aware of these rules, and I assume complete and total responsibility and liability for ensuring the strict adherence to such rules by me, my children, my ward(s).

2. I, acting in my individual capacity and/or as parents or guardians for a minor child or ward, hereby acknowledge the risk inherent with use of Association’s swimming pool area and the restricted areas of its facility. I freely assume complete and total responsibility for my own safety, actions, and behavior as well as for those actions of my children, ward(s), allowed guests (per the Pool Rules).

3. I acknowledge that I and my children, ward(s), guests may not be capable swimmers.

4. I, acting in my individual capacity and/or as parents or guardians for a minor child or ward, understand and acknowledge that LIFEGUARDS ARE NOT PRESENT at the swimming pool.

5. I, acting in my individual capacity and/or as parent or guardian for a minor child or ward, hereby acknowledge that it is my sole responsibility to admit only those persons into the swimming pool area, or its associated restricted area who are authorized users and for whom I assume personal responsibility. I further acknowledge that I am personally liable for the actions of my children, wards, and any guests thereof, who I, my children or ward(s) may admit into the swimming pool area. I further acknowledge that I am personally responsible and liable for the safety, actions and behaviors of any person entering into the swimming pool area through my, my children or ward(s) negligence or failure to strictly adhere to the applicable pool rules.

6. I, acting in my individual capacity and/or as parents or guardians for a minor child or ward, agree NOT to open, or allow my children or ward(s) to open, the pool gate for other Association members, their children, ward(s) or guests

7. I, acting my individual capacity and/or as a parent or guardian for a minor child or ward, understand that use of the Association Pool and Pool Area is a membership privilege which may be revoked at any time by the Association’s Board of Directors at their discretion or for the violation of any of the above-mentioned items.

8. This form will be valid for only one swim season. A new form must be submitted each year.

9. I, acting in my individual capacity and/or as parent or guardian for a minor child or ward, hereby forever release, acquit, discharge, indemnify, and hold harmless Association Released Parties of and from any and all causes of action, claims, suits, damages and demands of every kind of nature, known or unknown, anticipated or unanticipated, related to the use of Association’s swimming pool, and its associated restricted area, for all reasons stated above, unless caused sole and directly by the gross negligence or willful misconduct of Association.

 

 

 

 

 

Antiquity Pool Rules & Policies

2026 Season

Again, with the 2026 pool season, there will be  NO lifeguards on duty and use of the pool, pool facilities and surrounding areas (hereinafter “Pool”) will be deemed as Swim At Your Own Risk’.

The safety, health and comfort of all homeowners and their guests are the basic objectives of the following rules and policies. These rules are similar to rules at other pools in the area and are in compliance with Mecklenburg County regulations. It is the duty and responsibility of all homeowners & their renters, their children, and guests, to adhere to and encourage compliance of these rules.  For purposes of these rules a homeowner shall be defined as the owner of a property within the Antiquity development and renter shall be defined as anyone that has rented from a homeowner.  Association shall be defined as the Antiquity-Cornelius Community Association, Inc.

  • Enter At Your Own Risk: By entering the Pool, you agree that you are entering these premises at your own risk and you agree to take responsibility to follow the published and posted rules for yourself, family members and guests. Failure to follow these rules may result in loss of pool privileges.
  • Pool will be opened from Saturday May 2, 2026 through Sunday September 27, 2026 from 8:00 AM until dusk or 8:00 PM (whichever occurs first).
  • In the event of a serious injury or life-threatening emergency, call 911 and then call Hawthorne Management Company at 704-377-0114.  (This number will be posted at the Pool). Note: There is an AED and First Aid kit mounted to the wall near the pool shower. A Phone is mounted to the wall should it be necessary to call 911.
  • Any person that is not capable of swimming the length of the Pool unassisted without touching the sides or bottom of the Pool must be accompanied at all times in the Pool by someone that is capable of doing so.
  • All children, under the age of 16, are required to be accompanied at all times in the Pool by his or her own parent or guardian who will be directly responsible for them.
  • All who enter any part of the Pool agree to release and indemnify the Association from any claims, losses, or liability arising out of the use of the Pool by any person.
  • Babysitters employed by homeowners for their children may be asked for a written permission slip stating that they are the representatives of the parents while making use of the Pool without the parents present.
  • Key cards are required for entrance into the Pool. Key cards will be activated upon receipt of the signed Pool Waiver Form and this Signed Pool Rules & Policies Form. Homeowners who rent their property are responsible for getting key cards to renters, as well as having the renters sign the Waiver Form and this Pool Rules & Policies Form.
  • In the event that the homeowner is not current with their dues, membership will be suspended and the key card deactivated until which time the dues are again current.
  • Entrance/exit to the Pool will be limited to the two gates: one upstairs into the upper deck area and the one at the bottom of the ramp.
  • All guests must be accompanied by a homeowner or renter while in the Pool. No more than four (4) guests are allowed per residence.
  • Homeowners and renters are responsible for his/her family and guests at all times. Homeowners will be held responsible for all actions, including the actions of their guests, and may be charged for damaged property.
  • Absolutely NO GLASS containers of any kind are allowed in or around the Pool.
  • No running, skating/rollerblading, pushing, wrestling or other horseplay, is permitted that is unsafe or disturbs the enjoyment of the Pool for all.
  • Footballs, basketballs, soccer balls and similar may not be used in or around the Pool at any time. Soft “nerf” type balls may be used in the Pool providing it does not cause a hazard or hindrance to those in the area.  No towels or foreign objects (paper, cans, etc.) shall be placed or used in the Pool at any time.
  • No diving allowed.
  • Swimmers must respect the lap lanes in the Pool and not interfere with those swimming laps.
  • No prolonged breath holding games. Studies have found that breath holding for extreme periods of time underwater may cause blackouts and/or seizures.
  • Homeowners or renters who display inappropriate behavior in or around the Pool will be asked to leave immediately and may be subject to losing pool privileges for the season at the discretion of the Association Board. Our Pool has a family atmosphere, please conduct yourself accordingly.
  • No smoking at any time in the Pool or surrounding common areas.  This includes e-cigarettes and vaping.
  • All swimmers should shower before entering the Pool.
  • Anyone that is incontinent shall not use the Pool without rubber pants or another type of approved swim diaper.
  • No rocks, debris, gum or spitting will be allowed in the Pool.
  • No person will be allowed in the Pool while wearing street clothes.  Absolutely NO cut-offs permitted. The wearing of street clothing and socks is forbidden in the Pool due to hygiene issues and can pose a major entrapment issue as clothing can get stuck in the suction ports of the filtration system.  Proper swimming attire is mandatory, which means a modest, comfortable garment specifically designed for swimming.
  • Admission to the Pool will be denied to all persons having any infectious disease. Anyone with an infectious or communicable disease or any kind of open wound should not use the Pool.
  • Persons with excessive sunburns, open sores, bandages, inflamed eyes, colds, nasal or ear discharge or any other ailments which could adversely affect water cleanliness, and or endanger the well-being of others will NOT be permitted in the Pool.
  • Absolutely NO PETS permitted in the Pool or tied to the pool fence.
  • No grills (gas or charcoal) will be allowed in or near the Pool without permission from Association.
  • Bicycles and scooters are NOT permitted inside the Pool.
  • All bicycles, scooters, skateboards, etc. should be parked in the designated area by the shed outside of the Pool. Do not leave anything near or block the main entrance and keep out of landscaped areas.
  • Anyone caught defacing or vandalizing bathrooms or any other part of the Pool may have their swim privileges revoked.
  • Trash and recycling are to be deposited into the proper receptacles.

Lightning Action Protocol

The Pool must be evacuated during any electrical storm. If the storm front lightning device sounds or flashes an alarm, the Pool must be evacuated.

There is a lightning detector at the Pool. If the lightning detector sounds or flashes those at the Pool must:

  • Immediately vacate the Pool
  • Lower Umbrellas
  • Lower Pop-Up Canopies
  • Return floats and toys to storage bin
  • Return chaises to flat position
  • Exit the Pool complex and go to a safe location.

Guidelines for Returning to Pool after a storm or after the lightning detector has alerted.

  • If at least 30 minutes have elapsed since the last lightning you may return to the Pool if the lightning detector is not flashing.
  • Remember the Antiquity Pool is Swim At Your Own Risk

Parties at the Pool:

  • All parties must be confirmed with the Association Board as well as Aqua Tech in advance of the party date.
  • The pool party request form, payment instructions, and Party Rules are available on your resident portal at https://AntiquityCornelius.connectresident.com.
  • Due to insurance and safety regulations, all resident pool parties can only take place during scheduled operating hours for the Pool.  All guests must be out of the Pool complex when the Pool is closed.

Pool Equipment:

  • The cost of any property damage due to negligence or misconduct will be charged to the responsible homeowner.
  • Any persons who are caught vandalizing or destroying Pool property or upper deck property (bathrooms, etc.) will have their pool privileges immediately revoked and parents or guardians will be held liable to pay for damages of same.
  • No unauthorized person will be allowed near the filter room at any time.
  • Under no circumstances are the drain lids to be removed from the bottom of the Pool.
  • No one at any time is to play with the cleaning implements, life ring, or other apparatus.
  • Pool furniture is not permitted to be removed from the Pool at any time. Additionally, if you, your family, or guests used an umbrella, please lower prior to leaving Pool area.
  • We request a towel be used when lying on lounge chairs. Suntan lotion stains and will ruin chairs and lounges.

Inflatables:

  • There is no objection to the use of small inflatable so long as they are used with respect to others in the Pool.
  • Discretion is asked when the Pool is at capacity because the object may hinder others from enjoying the Pool as well. Please use rafts when the Pool is not crowded.

 

Noise:

  • Due to the close proximity of some homes to the Pool, and so as NOT to interfere with other pool users, the noise level should be kept to a minimum. Battery operated radios and TV’s are permitted only on low volumes.
  • No abusive or objectionable language will be permitted on Association property.
  • Any contracted party with use of DJ will be subject to acceptable noise levels per City of Cornelius Ordinances.
  • Residents may not employ DJ’s or any other vendors for their personal party unless prior authorization is received from the Association Board.

Behavior:

  • Anyone that is impaired (by use of alcohol, drugs or anything similar) or anyone exhibiting disorderly conduct will be ejected from the Pool and police will be called if deemed necessary.

Upper Deck:

  • Our interior upper deck and surrounding premises, including Pool deck, are under constant security monitoring.
  • This ensures the safety and protection for all our homeowners and renters and their guests.
  • The Antiquity upper deck is available to homeowners during Pool operating hours. The upper deck is also available to homeowners for events on a rental basis. See amenity module on the dashboard of your resident portal at https://AntiquityCornelius.connectresident.com.

  • Key fobs should be kept in a secure location and not given to or used by anyone other than the assigned homeowner or renter.
  • For your key fob to be activated for the current Pool Season, the Pool Rules and Swim At Your Own Risk Waiver must be signed yearly by every adult 18 years or older who resides in the household.
